KLBC Activities Report For August 2024

KOPI O NIGHT - Financial Scandals in Malaysia: From the Bumiputera Malaysia Finance (BMF) to the 1Malaysia Development Berhad (1MDB)

The Bar Council Legal Aid Centre (Kuala Lumpur) (“LAC KL”), organised a “Kopi O Night”, at the LAC KL Training Room. It was held on 1 August 2024 from 6:30pm to 9:00pm and was attended by 32 participants. The distinguished speaker was Chooi Mun Sou from Chooi and Company. The event was moderated by Joachim Xavier and the discussion was on " Financial Scandals in Malaysia: From the Bumiputera Malaysia Finance (BMF) to the 1Malaysia Development Berhad (1MDB)." The informal setting allowed active participation, and positive feedback was received following the engaging discussions.

Organised by the Professional Development Committee, this Seminar was conducted by Dato' Jerald Allen Gomez. It was held at the Kuala Lumpur Bar Auditorium from 2:30pm to 4:30pm. We had 21 participants.

Art Law & Cultural Policies

Organised by the Professional Development Committee, this webinar was conducted by Ryan Su and was moderated by Thulasy Suppiah.

The webinar covered the following areas:-

(i) “Overview of arts and cultural policy”;
(ii) “Analysis of arts policy impact on production, consumption, and stakeholders (artists, cultural organizations, audiences)”;
(iii) “Creative strategies for leveraging arts policy to advance artistic and economic goals”;
(iv) “Legislation, rules, and regulations relevant to the arts industry”;
(v) “Discussion of intellectual property issues in the arts”;
(vi) “Laws related to censorship in artistic expression”;
(vii) “Critical examination of contracts in arts and culture, highlighting potential conflict”; and
(viii) “Use of appropriate legal language and terminology in arts and culture contexts”.

It was held via Zoom from 2:30pm to 4:30pm. We had 44 participants.

Islamic Estate Planning

Organised by the Professional Development Committee, this webinar was conducted by Sarah Ali.

The webinar covered the following areas:-

(i) “Brief definition and explaination on Hibah, Wasiat, Amanah Islam, Wakaf and Faraid according to the Syariah Principles”;
(ii) “Examples of cases on each lslamic lnstruments”;
(iii) “Advantages and the after effects of executing the lslamic lnstruments”; and
(iv) “Stamp Duties and Real Property Gains Tax (RPGT) on Hibah, Wasiat, lslamic Trust (if any)- Transmission on the immovable assets”.

It was held via Zoom from 2:30pm to 4:30pm. We had 57 participants.

Meeting with the Director of Jabatan Agama Wilayah Persekutuan

The meeting between the Director and Enforcement Officers of Jabatan Agama Wilayah Persekutuan (“JAWI”), and the Bar Council Legal Aid Centre (Kuala Lumpur) (“LAC KL”) Syariah Committee was held on 6 August 2024 at 2:30pm in the Bilik Mesyuarat Utama, JAWI. The Syariah Committee was represented by Zulsyahmi Husaini bin Kamarulzaman, the Project Head of the Syariah Committee. Among the issues discussed were collaboration between LAC KL and JAWI, outreach programs, and client referrals.

Perspectives Of A Counsel In International Arbitration

Organised by the Civil Practice & Court Liaison Committee, this seminar was presented by Ng Jern-Fei KC and moderated by Anishaa Sundramoorthy.

The webinar covered the following areas:-

Legal Strategy

(i) “Developing a case theory”; and
(ii) “Project-planning”.

Advocacy Skills

(i) “Delivering effective oral submissions”; and
(ii) “Cross-examination”.

Practical Considerations

(i) “Prioritising client’s commercial objectives”; and
(ii) “Time management”.

It was held from 11:00am to 1:00pm at the KL Bar Auditorium. We had 41 participants.

Statutory Agreements Pursuant To The Housing Development (Control And Licensing) Act 1966

Organised by the Corporate & Conveyancing Practice Committee, this webinar was presented by Dato’ Pretam Singh Darshan Singh and Surendra Ananth and moderated by Sukhdev Kaur.

The webinar covered the following areas: -

(i) " What are Schedule G and H Agreements?";
(ii) “Is a Deed of Mutual Covenant necessary? Comparison with a Schedule H Agreement under the HDA”;
(iii) “The “Gated and Guarded Community” and issues”;
(iv) “Resident Associations – its formation, constitution and responsibilities”; and
(v) “Discussion on recent decided cases on the judicial review of decisions imposed by the local town councils, example MBPJ”.

It was held from 2:30pm to 4:30pm via Zoom. We had 52 participants.

Bar Council Legal Aid Centre Kuala Lumpur (“LAC KL”) Pupils Orientation for Compulsory Legal Aid Duty Batch 119/2024

The orientation for pupils of Batch 119/2024 was facilitated by Joachim Xavier on 7 August 2024 from 9:00am to 1:00pm at the Bar Council Auditorium. A total of 136 pupils attended the orientation.

Meeting with Pertubuhan Kesihatan dan Kebajikan Umum Malaysia (PKKUM)

The meeting between the PKKUM and the Bar Council Legal Aid Centre (Kuala Lumpur) (“LAC KL”) was held on 9 August 2024 at 11:00am in the LAC Training Room. The LAC KL representatives were Morhaneraj Rajakumaran, Chan Yen Hui, Parvin Kaur and Sumitra Veeriah. Among the issues discussed were collaboration between LAC KL and PKKUM, client referrals, pupils' training, and outreach programs.

Practical Tips On Drafting Of LOEs & Opinions And Duties Of Counsel

The seminars were presented by Anand Raj. The first session titled “Practical Tips On Drafting Of LOEs And Opinions” was held from 3:00pm to 4:15pm and was attended by 36 participants.

The session covered the following areas: -
(i) “Practical Tips On Drafting Letters Of Engagement (LOE)”;
(ii) “Possible Template LOE Language”;
(iii)
”Possible Opinion Formats”;
(iv) “Possible Qualifications For Opinions”; and
(v)
”Limitations”.

The second session titled” Duties of Counsel and The Dangers of Pandering to Clients” was held from 4:45pm to 6:00pm and was attended by 30 participants.

The session covered the following areas: -
(i) “Duties of Counsel”;
(ii) “Significance of Being an Officer of the Court”;
(iii) “The Interests of Clients and Other Interests”;
(iv) “What Constitutes ‘Pandering’?”;
(v) “Symptoms and Dangers of Pandering”; and
(vi) “Assessing Yourself: Are You a Client Panderer and Do You Need to Be One?”.

Pupils Admission To The Bar Briefing

Organised by the Young Lawyers & Pupils Committee, the briefings for the Pupils Admission to the Bar for August 2024 was held at the Kuala Lumpur Bar Auditorium on: -

(i) 12 August 2024, from 12:30pm to 1:00pm. The briefing was conducted by Tay Kit Hoo and was attended by 47 pupils.

(ii) 16 August 2024, from 4:00pm to 5:00pm. The briefing was conducted by Ooi Jia Liang and was attended by 71 pupils; and

(iii) 30 August 2024, from 9:00am to 10:00am. The briefing was conducted by Ooi Jia Liang and was attended by 56 pupils.

Pupils Introduction And Diversity & Inclusion Session

Jointly organised by the Young Lawyers & Pupils Committee and the Gender Equality & Diversity Committee, the Pupils Introduction Session in August was held on 12 August 2024 at the KL Bar Auditorium, Level 4. Led by Ooi Jia Liang, the session was attended by 90 pupils. The purpose of the Pupils Introduction Session is to introduce pupils to the structure of the Malaysian Bar and the Kuala Lumpur Bar, the elections to both the Bar Council and the Kuala Lumpur Bar Committee, and the highlights of the Malaysian Bar. It included a session for students to discuss issues and problems they encountered during their pupillage period.

Also included in the said Pupils Introduction Session was a session on “Diversity & Inclusion: Unconscious Bias”. The aim of this segment is to educate and create awareness about how our unconscious biases and innate prejudices lead to poor judgment and poor decision-making, which in turn result in unintentional discrimination and overall poor "diversity & inclusion" practices in our workplaces. The session was conducted by Tay Kit Hoo.

Bar Council Legal Aid Centre Kuala Lumpur (“LAC KL”) Pupils Orientation for Compulsory Legal Aid Duty Batch 119/2024

The orientation for pupils of Batch 119/2024 was facilitated by Morhaneraj Rajakumaran on 12 August 2024 from 9:00am to 1:00pm at the Bar Council Auditorium. A total of 141 pupils attended the orientation.

Organised by ATC Law School, the Kuala Lumpur Bar Chairman, Alvin Oh Seong Yew was invited to present a session on “What To Expect During Pupillage” from 11:00am to 12:30pm at ATC. Ooi Jia Liang joined him for the panel session.

Organised by ATC Law School, the Bar Council Legal Aid Centre (Kuala Lumpur) (“LAC KL”), opened a booth to promote the services provided by LAC to the public. It was held at ATC (KL) from 12:00pm to 4:00pm. The LAC representatives were Jeevanathan and Shenise Charles Daya. They were assisted by pupils Letchumanan a/l Anbalagan and Eless Binti Francis.

Organised by the Gender Equality & Diversity Committee, this seminar was held on 17 August 2024 and was presented by Mandeep Singh Bains and Nadiah Ibrahim and moderated by Tay Kit Hoo.

The seminar covered the following areas: -

(i) “Posture in the office (Physiotherapist)”; and
(ii) “Importance Of Professional Appearance (Certified trainer)”.

It was held at the KL Bar Auditorium from 2:15pm to 5:15pm. We had 21 participants.

Meeting With The Kuala Lumpur Court Director

The meeting between the Director of the Kuala Lumpur Courts and Civil Practice & Court Liaison Committee (“CPCLC”) was held on Friday, 23 August 2024 at 3:00pm at Bilik Anggerik, Level 6, Kuala Lumpur Court Complex. The Kuala Lumpur Bar Committee was represented by the KLBC Chairman, Alvin Oh Seong Yew, Honorary Secretary and Co-Chairperson of CPCLC, Nimalan Devaraja, Co-Chairperson of CPCLC, Shugan Raman and CPCLC Directors Aarthi S. Jeyarajah and Grace Teng Peck Yin.

The purpose of this meeting was to discuss feedback received from members on the facilities and infrastructure of the Kuala Lumpur Courts, including pending issues i.e. parking charges outside the Kuala Lumpur Court Complex, renovation of the Cafeteria, the relocation of the Bar Room, and other related matters.

Organised by the Bar Council Legal Aid Centre (Kuala Lumpur) (“LAC KL”), this TOT session was presented by Harleen Kaur and Ravinder Singh. It was held on 24 August 2024, from 9:30am to 12:30pm at the LAC KL Training Room, with 13 volunteer lawyers in attendance.
