KLBC Activities Report For April 2024

 

12 March to 8 April 2024
Donation Drive In Conjunction With Ramadhan 2024 / 1445H

The Kuala Lumpur Bar Committee, in solidarity with our Muslim brethren during the fasting month, organised a donation drive from 12 March to 8 April 2024. We managed to raise RM2,700 which we have channelled to Pertiwi and Kechara Soup Kitchens. Our deepest gratitude to all who have generously contributed to this donation drive.

Basics Of Criminal Appeals

Organised by the Criminal Law Practice Committee, this webinar was presented by Collin Arvind Andrew.

The webinar covered the following areas: -

(i) "Effectiveness of Criminal Revision vs Criminal Appeal - which mode to take?";
(ii) "Navigating Through Rules and Procedures of Criminal Appeals";
(iii) "Exploring section 310 Criminal Procedure Code - Applications with Examples"; and
(iv) "Appellate Advocacy - Crafting Persuasive Submissions".

It was held from 2:00pm to 4:00pm via Zoom. We had 77 participants.

Pupils Call Briefing

The briefings for the Pupils Admission to the Bar Briefing for April 2024 was held at the Kuala Lumpur Bar Auditorium on:-

(i) 16 April 2024, from 10:00am to 11:00am, with 42 pupils attending the briefing. The briefing was conducted by Tay Kit Hoo;

(ii) 22 April 2024, from 10:00am to 11:00am, with 11 pupils attending the briefing. The briefing was conducted by Ooi Jia Liang ; and

(iii) 30 April 2024, from 10:00am to 11:00am, with 11 pupils attending the briefing. The briefing was conducted by Ooi Jia Liang.

Effective Management Of IT Disputes

Organised by the Corporate & Conveyancing Practice Committee, this webinar was presented by G. Vijay Kumar and moderated by Aissa Fiyaz Khalid Bin Azmil Khalili.

The webinar covered the following areas: -

(i) “Introduction to the Information Technology (IT) sector”;
(ii) “Drafting effective IT contracts”;
(iii) “Common issues arising in the implementation of IT projects”; and
(iv) “Navigating and effectively preparing for IT-related disputes”.

It was held via Zoom from 2:30pm to 4:30pm. We had 59 participants.

Pupils Introduction and Diversity & Inclusion Session

The Pupils Introduction Session in April was held on 22 April 2024 and 30 April 2024 at the Kuala Lumpur Bar Auditorium. Led by Ooi Jia Liang, the session was attended by 96 pupils and 102 pupils respectively. The purpose of the Pupils Introduction Session is to introduce pupils to the structure of the Malaysian Bar and the Kuala Lumpur Bar, the elections to both the Bar Council and the Kuala Lumpur Bar Committee, and the highlights of the Malaysian Bar. It included a session for students to discuss issues and problems they encountered during their pupillage period.

Also included in the said Pupils Introduction Session was a session on “Diversity & Inclusion: Unconscious Bias”. The aim of this segment is to educate and create awareness about how our unconscious biases and innate prejudices lead to poor judgment and poor decision-making, which in turn result in unintentional discrimination and overall poor "diversity & inclusion" practices in our workplaces. The session on 22 April 2024 was conducted by Brenda Rangithan, and the session on 30 April 2024 was conducted by Tay Kit Hoo.

Understanding Annual Reports And Financial Statements

Organised by the Professional Development Committee, this Seminar was conducted by Lim Kien Chai.

The webinar covered the following areas: -

(i) “Introduction on Importance of Annual Reports and Financial Statements”;
(ii) “Accounting terms and jargons made understandable for lawyers”;
(iii) “What are the components of an Annual Report?”;
(iv) “Why the term “Trial Balance”?”;
(v) “Why the term “Balance Sheet”?”;
(vi) “What are the salient features of a Balance Sheet?”;
(vii) “What are Assets and what types are there?”;
(viii) “What are Liabilities and what types are there?”;
(ix) “Are Balance Sheet liabilities an indication of a “not good” financial position and/or poor financial management?”;
(x) “The relationship between Borrowings/Debts and Shareholders’ Fund.”;
(xi) “What is Debt Equity Leverage?”;
(xii) “What stakeholders, in particulars creditors, lenders, and investors, look for in a company?”;
(xiii) “What is Depreciation of Fixed Assets and what is its impact on a company’s profit?”;
(xiv) “What is an Income Statement?”;
(xv) “What lessons can we learn from the Reserve Accounts of a company?”;
(xvi) “When can Board of Directors declare dividends without running foul of the law?”;
(xvii) “Balance Sheet and Income Statement – what do they boil down to?”;
(xviii) “What a Balance Sheet and an Income Statement can never show?”; and
(xix) “The use of a Balance Sheet and an Income Statement: - what are their inherent limitations?”

It was held at Kuala Lumpur Bar Auditorium from 9:00am to 5:00pm. We had 81 participants.

Organised by the Corporate & Conveyancing Practice Committee, this webinar was presented by Valerie Chong and moderated by Richard Teh Tai Sheng.

The webinar covered the following areas: -

(i) “The Jurisdiction Of The Strata Management Tribunal”;
(ii) “The Procedures”;
(iii) “Forms”; and
(iv) “Case Studies”.

It was held via Zoom from 3:00pm to 4:00pm. We had 90 participants.

Organised by the Young Lawyers & Pupils Committee, this webinar was conducted on 29 April 2024 by Tay Kit Hoo.

The webinar covered the following areas: -

(i) “Interviewing Client For Family Matters – Fact Finding”;
(ii) “Negotiating For Settlement – Resolving Dispute And Exploring Alternative Options”;
(iii) “Exploring The Legal Requirements Of A Joint Petition”; and
(iv) “Junior Lawyers’ Perspective On Joint Petition”.

It was held via Zoom from 2:30pm to 4:30pm. We had 96 participants.

Bar Council Legal Aid Centre (Kuala Lumpur) (“LAC KL”) Pupil’s Midterm Review

The Mid Term Review (“MTR”) for Batch 117/2024 was carried out by the project heads. Pupils were given the opportunity to discuss concerns and offer suggestions for enhancing the programs over the following seven weeks. The MTR sessions were held in person, and representatives from the associated NGO partners were also present to provide their feedback.
