KL Bar Monthly Social Get-together
About 15 lawyers gathered at BAR 1981 @ Solaris Publika on 3 January 2014 for the January Social Get-together. Everyone had a great time but parted early at 11:00 pm.

PDC Seminar on The Failed Malaysian Solution of the Asylum Seeker Conundrum in Australia
Jeswynn Yogaratnam from Charles Darwin University presented this Free seminar which was held at the KL Bar Auditorium at 4:00 pm on 7 January 2014. The seminar was attended by 25 participants. The seminar covered "Insight to International Asylum and Refugee Law and policy", "Reflect on Australian Law and compliance with the 1951 Refugee Convention", "Review of the Australian High Court decision on the Malaysian Solution case", "Examining subsequent amendments to the Australian Migration Act 1958 (Cth) post High Court decision" and "Should Malaysia be a signatory to the 1951 Refugee Convention?"

Pupils Introduction Session
Organised by the KL Bar Pupils Welfare Committee, the introduction session for January was held on 8 January 2014. The session, attended by 80 pupils, was led by Vince Chong. Pupils were briefed on the structure of the Malaysian Bar and the Kuala Lumpur Bar, the election to both the Bar Council and the Kuala Lumpur Bar Committee (“KLBC”) and the highlights of the Malaysian Bar. It included a session for pupils to raise issues and problems faced by them during their pupillage period and members of the KLBC were on hand to provide input and possible solutions. Amongst the issues raised by the pupils at this session were the unfriendly staff at the RKKK (Petition) Registry.

Joanne Long from Messrs Khairuddin Ngiam & Tan presented this seminar which was held at the KL Bar Auditorium at 3:00 pm on 10 January 2014. The seminar was attended by 85 participants. The seminar covered "Terms of Memorandum of Agreement", "Searches", "Closing / Completion Structures", "Registration of Ships", "Loan Structure", "Securities", "Loan Documentation", "Drawdown Procedure", "Registration of Mortgage", "Instructions from Offshore Law Firms" and "Qualifications in the Opinions".

KLYLC Seminar on Basics of Cross Examination in Civil and Commercial Trials
Brendan Navin Siva from Messrs Brendan Siva presented this seminar which was held at the KL Bar Auditorium at 3:00 pm. The seminar, organised by the KL Bar Young Lawyers Committee (“KLYLC”), was attended by 95 participants. The seminar was designed to teach junior lawyers the basics of cross-examination and to impart useful lessons and pointers for the young advocates in their cross-examination of witnesses. The seminar covered the following areas, "The objective and purpose of cross-examination”, “The nature of cross-examination in civil and commercial matters”, “Common mistakes during cross-examination” and “Practical tips for young lawyers”.

PDC Seminar on Conducting Civil Trials
Colin Andrew Pereira and Sanjeev Kumar Rasiah presented this seminar which was held at the KL Bar Auditorium at 2:45 pm on 24 January 2014. The seminar was attended by 123 participants. The seminar covered "Pre-Trial Case Management", "Preparing Bundle of Pleadings", "Preparing Bundle of Documents", "Preparing Statement of Agreed Facts and Statement of Issues To Be Tried", "Preparing List of Witnesses", "Preparing Summary of Case", "Preparing Witness Statements", "Opening Speech", "Examination In Chief", "Cross Examination", "Re-Examination" and "Evidential Issues".

KLYLC Laser Tag Competition
The KL Bar Young Lawyers Committee (“KLYLC”) organised a Laser Tag Competition on 24 January 2014 at 7:30 pm at Galactic Laser, T-012A, 3rd Floor, North Court, Mid Valley Megamall. Seven teams participated in the competition, namely, "Pew Pew Pew !!", "RWY Black Panther", "The Rascals", "Nobody’s Angels", "The Warriors of Legolas", "TAG UR IT" and "The Lasernators". The Winners were The Rascals, 1st Runner up were The Warriors of Legolas and 2nd Runner up were Pew Pew Pew!!.

PDC Seminar on RPGT: The Basics and the Advanced
Thenesh Kannaa presented this seminar which was held at the KL Bar Auditorium at 3:00 pm on 28 January 2014. The seminar was attended by 102 participants. The seminar covered "The basic rules of RPGT", "Acquisition price and disposal price", "Acquisition date and disposal date", "Exemptions", "Nominal and effective rates of tax", "Special cases", "The administrative responsibilities of acquirer and disposer", "Cases where the acquirer may be assessed", "Ultra vires subsidiary legislation in relation to tax rate", "RPGT when dealing with shares, debentures and warrants" and "Situations when the gain from disposal of real property is subject to income tax rather than RPGT".

Corporate Workshop for Pupils
The KL Bar Pupils Welfare Committee organised a corporate workshop specifically for pupils on 6 February 2014 focusing primarily on the practical aspects of handling a brief, covering the following areas, “"Overview: Negotiation, due diligence and drafting process", "Commercial considerations", "Practical pointers including common mistakes when drafting", "Salient clauses including consideration, conditions precedent, completion etc.", "Covenants and warranties by both Vendors and Purchasers", "Boiler plate clauses" and "Remedies for breach of contract". 50 pupils attended the workshop which was conducted by Sheba Gumis.

PDC Seminar on An Introduction to Motor Insurance Personal Injury Claims
Ravin Singh presented this Free seminar which was held at the KL Bar Auditorium at 3:00 pm on 7 February 2014. The seminar was attended by 102 participants. The seminar covered "Types of Motor Policies", "Exclusions/Extensions", "Duty of Disclosure", "Accident Claims" and "Basic Dos and Don'ts".

Organised by the KL Bar Pupils Welfare Committee, the introduction session for February was held on 12 February 2014. The session, attended by 75 pupils, was led by Jeremiah R. Gurusamy. Pupils were briefed on the structure of the Malaysian Bar and the Kuala Lumpur Bar, the election to both the Bar Council and the Kuala Lumpur Bar Committee (“KLBC”) and the highlights of the Malaysian Bar. It included a session for pupils to raise issues and problems faced by them during their pupillage period and members of the KLBC were on hand to provide input and possible solutions. Amongst the issues raised by the pupils at this session were simplifying the Borangs 1-8 and having a centralised database for the Attorney General, Bar Council and State Bars.

An Appreciation Dinner was held on 13 February 2014 at A Li Yaa for members of the Bar, pupils-in-chambers and people who had contributed to the activities of the KLBC and its sub-committee over the last one term. Click here to view the photos.

KL/Selangor Bar Games
The 13th Kuala Lumpur/Selangor Bar Games for the Lall Singh Muker Challenge Trophy was held on 15 February 2014 with the KL Bar playing hosts. KL Bar beat the Selangor Bar 4-3 winning at netball, volleyball, pool/snooker and table-tennis to become the overall champion. Selangor Bar won golf, badminton and soccer. Click here to view the photos.

CCPC Practical Workshop on 10Cs of Practice in Conveyancing (Part I)
Lee Peck Ha presented this workshop which was held at the KL Bar Auditorium at 9:00 am on 18 February 2014. The seminar was attended by 70 participants. The seminar covered "How can you cope with your clients?", "What do you need to do for your clients?", "Is the SPA standard enough?", "How does your client inform the world that this property is his?" and "Why is it so difficult to transact smoothly for your client?".

Annual General Meeting of the Kuala Lumpur Bar
The 22nd Annual General Meeting (“AGM”) of the Kuala Lumpur Bar scheduled for 2:00 pm kicked off with a short briefing on the Implication of the Personal Data Protection Act 2010 for Law Firms by Jeremiah R. Gurusamy and Foong Cheng Leong. The office-bearers of the KLBC for 2014/15 elected at the AGM were: Chairman - Dipendra Harshad Rai; Committee members - Goh Siu Lin, Amir Bahari, Jeremiah R. Gurusamy, Peter-Douglas Ling,  Harleen Kaur (Leena), Foong Cheng Leong, Choo Dee Wei, Lim Chi Chau, Shashi Devan a/l Thalmalingam and Vinu Kamalananthan. Ravinder Singh Dhalliwal (Ravin) was elected as the KL Bar’s Representative to the Bar Council.

23rd “SPORTS CARNIVAL” – KL BAR vs RSC (Royal Selangor Club)
This event was held on 22 February 2014 with the KL Bar playing hosts. KL Bar beat the RSC 4-3 winning at tennis, badminton, netball and boat race and drew at pool/snooker to become the overall champion. RSC won cricket, soccer and hockey. Click here to view the photos.

PDC Seminar on Corporate Litigators’ WMDs: Winding-up, Minority Oppression and Derivative Action
Lee Shih from Messrs Skrine presented this seminar which was held at the KL Bar Auditorium at 3:00 pm on 25 February 2014. The seminar was attended by 29 participants. The seminar covered "The Corporate Litigator’s Toolkit", "Foss v Harbottle: The Two-Headed Dragon", "The WMDs: Winding-up, Minority Oppression and Derivative Action", "Holding the Fort: Interim Remedies", "Arbitration and Shareholder Disputes" and "Case Studies: 50/50 Split, The Good Wives, 24 and the Tale of Lazarus".

KLYLC Introductory Session to the Legal Profession for Law Undergraduates
The KL Bar Young Lawyers Committee (“KLYLC”) organised a 4th Introductory Session to the Legal Profession for Law Undergraduates to provide them with an insight into the legal profession. The session was held at the KL Bar Auditorium from 9:15 am to 4:00 pm on 1 March 2014. The following topics were presented, “History, Role and Relevance of the Malaysian Bar” by Richard Wee, “Myths and Realities of Practice” by Jeremiah R. Gurusamy, “Crossroads” by the KLYLC and “s.42 Legal Profession Act – the answer to life, universe and everything” by Edmund Bon Tai Soon. 55 participants from Inti International University College, KDU University College, Taylor's University and HELP University College attended this Introductory Session.

Meera Samanther, Goh Siu Lin and Tham Hui Ying presented this Free talk jointly organised by the Practitioners Affairs Committee (“PAC”) and Professional Development Committee (“PDC”) which was held at the KL Bar Auditorium at 10:00 am on 7 March 2014. The seminar was attended by 66 participants. The seminar covered "Sex and Gender", "Violence Against Women" and "Women and the Law".

PDC Seminar on Fundamentals of Bankruptcy Proceedings
Trevor Jason Mark Padasian from Messrs Skrine presented this seminar which was held at the KL Bar Auditorium at 3:00 pm on 11 March 2014. The seminar was attended by 64 participants. The seminar covered "Introduction", "Bankruptcy principles", "Problematic issues in bankruptcy" and "Relationship to winding-up proceedings".

Organised by the KL Bar Pupils Welfare Committee, the introduction session for March was held on 19 March 2014. The session, attended by 71 pupils, was led by H.R. Dipendra and Ravin SIngh. Pupils were briefed on the structure of the Malaysian Bar and the Kuala Lumpur Bar, the election to both the Bar Council and the Kuala Lumpur Bar Committee (“KLBC”) and the highlights of the Malaysian Bar. It included a session for pupils to raise issues and problems faced by them during their pupillage period and members of the KLBC were on hand to provide input and possible solutions. Amongst the issues raised by the pupils at this session were pupil’s allowance, having to pay for the Bahasa Malaysia Exemption Certificate, outdated Pupils Handbook, heavy workload, unfriendly staff at the RKKK (Petition) Registry and the need to sit for the Ethics Exam again after having done the course during CLP.

The seminar was attended by 28 participants. The seminar covered "Learning to identify IP Assets", "Commercialisation of IP Assets", "Enforcement" and "Licensing exercise".

1st KLYLC Meeting
The KL Bar Young Lawyers Committee (“KLYLC”) held its first meeting for the term 2014/2015 at the KL Bar Auditorium. The structure of the KLYLC was reorganised to consist the following structures: Community, Professional Development, Young Professionals Alliance, Sanctuary and Charity Night. The following people were nominated or volunteered to head the structures, Community - Jacenta James, Professional Development - Dinesh Nandrajog, Young Professionals Alliance - Dinesh Muthal, Sanctuary - Victor Tuang Geng Yong and Charity Night - Nimalan Devaraja. Lim Yin Faye was appointed as the Representative to the National Young Lawyers Committee.

Meeting with Pejabat Tanah dan Galian Selangor
This Meeting was by invitation from the Pejabat Tanah dan Galian Selangor (PTGS) and was held at 9:00 am at the PTGS, Shah Alam. The KLBC was represented by Amir Bahari, Chairperson of the KL Bar Corporate & Conveyancing Practice Committee,who reported that amongst the issues discussed were format of photocopy of NRIC, Strata Titles in PTD Klang to be fully computerised and PTGS officers willing to give talks on the common mistakes made by lawyers when presenting their documents to PTGS.

It included a session for pupils to raise issues and problems faced by them during their pupillage period and members of the KLBC were on hand to provide input and possible solutions. Amongst the issues raised by the pupils at this session were, no complete and comprehensive guide to the Borangs 1-8, pupil’s allowance, heavy workload, unfriendly staff at the RKKK (Petition) Registry and the need to sit for the Ethics Exam again after having done the course during CLP.

Reference Proceedings in Respect and Memory of Departed Members of the KL Bar
A Reference in respect and memory of 3 departed members of the Kuala Lumpur Bar was held at the Kuala Lumpur High Court (RKKK 2) on Friday, 11 April 2014 at 9:00 am. The Reference was presided by Y.A. Dato’ Zaleha Binti Yusof. The departed members were Allahyarham Puan Fauziah Binti Mustaffa, the late Mr Sivamohan Nagendra and the late Mr Hariram Jayaram. 1st KLYLC Community Project at the Myanmar Learning Centre, Kepong
The KL Bar Young Lawyers Committee organised its first Community Project on 19 April 2014 with the children at the Myanmar Learning Centre, Kepong. It was an outing with the children where the children were taken for a movie and treated to lunch by members of the KLYLC.

YPA Get Together
The Young Professionals Alliance (“YPA”), of which the KL Bar Young Lawyers Committee is a part of, organised a social get together on 26 April 2014 at Page 2, Publika. It was a simple dinner to meet people from various professional background. The YPA is a platform to encourage friendship and to booster a bridge among people from different career backdrops.
