PDC Seminar on Goods and
Services Tax: Some Issues Arising on Implementation
Organised
by the KLBC Professional Development Committee (PDC), this seminar was
presented by Dr. Arjunan Subramaniam on 1 July 2015 at the KL Bar Auditorium
from 11:00 am to 12:00 pm. The seminar was attended by 97 participants. The
seminar covered the following topics: "Registration; Sales of Commercial
land, is there GST?”; “Must or can a purchaser of Commercial land register for
GST?”; “When can a purchaser of Commercial land recover input tax incurred?”; “Land
Transactions”; “When is land “goods” and when “services”?”; “Tax consequence of
the difference in concept: Joint Venture in land; development – Issues and
Analysis”; “Is SOHO exempt as residential premises?”; “Is rent from service
apartment subject to GST: Meaning of “residential”?”; “The Gift Rule and GST
Implications; Purchase of houses and gifts”; “Paragraph 5(1), First Schedule,

Services, Consultant Services: Zero Rated: Conditions for Zero Rating and
Penalty or Extra Fee for Goods and Services Purposes? Characteristics of

Pupils Introduction Session
As
a monthly tradition organised by the KLBC Pupils Committee, the Pupils
Introduction Session for July was held on 2 July 2015. The session, attended by
73 pupils, was led by its Chairperson, Shashi Devan. The purpose of the session
is to introduce pupils to the structure of the Malaysian Bar and the Kuala
Lumpur Bar, the election to both the Bar Council and the Kuala Lumpur Bar
Committee (KLBC) and the highlights of the Malaysian Bar. It included a session
for pupils to raise issues and problems faced by them during their pupillage
period and other members of the KLBC were also present to provide input and
possible solutions. Similar like previous sessions, the pupils were also shown
a video montage of the History of the Malaysian Bar.

PDC Seminar on Memorandum of
Understanding
Organised
by the KLBC Professional Development Committee (PDC), this seminar was
presented by Lim Kien Chai on 7 July 2015 at the KL Bar Auditorium from 9:30 am
to 4:30 pm. The seminar was attended by 56 participants. The seminar covered
the following topics: “Introduction regarding the use of an MOU in the
business, commercial and corporate world”; “The legal nature”; “Why is an MOU
not legally binding?”; “How could an MOU be made legally binding?”; “Under what
circumstances could an MOU be legally binding or not legally binding?”; “Drafting
an MOU”; “With full practical illustrations of drafting a non-legally binding
or a legally binding MOU”; “Even if the MOU itself is not legally binding, to
obtain a critical understanding of an MOU and whether it has the force of the
law to protect your client’s business interests and Other formalities,
notwithstanding its non-legal nature".

YLC Seminar on The
Construction of the Payment and Adjudication Act
Organised
by the KLBC Young Lawyers Committee (YLC), this seminar was presented by Anilraj
Verdamanickam on 14 July 2015 at the KL Bar Auditorium from 2:30 pm to 4:30 pm.
The seminar was attended by 16 participants. The seminar covered the following
topics: “A review of the salient provisions of CIPAA"; "Discussion on
the ‘lacunas’ of CIPAA"; and "Brief examination of the case
laws".

Meeting with the IPD Sentul
A meeting
with the police officers from IPD Sentul was held on 24 July 2015 at 3:00 pm. KLBC was represented by its Chairman Ravin Singh, Honorary Secretary Goh Siu Lin and Criminal Practice Committee Chairperson Lim Chi Chau. Similar issues which were raised at the meeting with IPD Dang Wangi were discussed and IPD Sentul had agreed
to adopt the similar arrangements that we had made with IPD Dang Wangi. IPD Sentul had just provided us with the contact numbers of their respective officers-in-charge and a notification would be issued out to members shortly.

Hike to Chilling Waterfalls,
Kuala Kubu Bahru
Organised
by the KLBC Pupils Committee, 11 pupils and lawyers participated in the hiking

YLC Raya Visit to Pusat Jagaan
Baitul Amal
The
KLBC Young Lawyers Committee organised a visit to Pusat Jagaan Baitul Amal
Petaling Jaya ("Home") which is located in Petaling Jaya on 26 July
2015 to have a small Hari Raya celebration with the children residing there.
The home currently houses about eight children ranging from the ages of 2 to 11
years old and they are well taken care of by a small team of caretakers and a
part-time resident cook. The children staying at the safe home came mainly from
broken homes, were subjected to neglect or abuse, and/or single parent
households who are poor and unable to support themselves and their child. Click
