Statement of the Information Technology Committee (ITC) of Kuala Lumpur Bar Committee

We make reference to the recent announcement by the Government of Malaysia of their proposals to amend the Printing Presses and Publications Act 1984 (PPPA), to include online content. ITC acknowledges that the proposed amendments are yet unknown. Nonetheless, ITC would implore and advocate that any amendments to the PPPA ought to be inline with the Right of the Freedom of Speech enshrined in the Malaysian Federal Constitution. ITC is also guided by the MSC Malaysia Bill of Guarantee, which guarantees no censorship on the Net. Any form of censorship or impediment to this enshrined right would be unconstitutional and a step backwards for Malaysia. ITC wishes to highlight that at a recent Information Technology Law Forum hosted by ITC, where the Honourable Minister of Information, Communications and Culture, Dato’ Seri Rais Yatim was invited, and the Honourable Deputy Minister Dato’ Maglin Dennis D’Cruz, had attended on behalf of the Minister; the Deputy Minister in his speech had s...

KL Bar IT Law Forum - 12 November 2010

About four days before the Forum, KLBC received a letter from the Minister of Information Communications and Culture that he could not attend to officiate at the IT Law Forum after having accepted the invitation earlier on. Thankfully, the Deputy Minister, Dato’ Maglin Dennis D’Cruz graciously agreed to attend on behalf of the Minister and opened the Forum. The Deputy Minister gave a resounding speech, confirming that the Government of Malaysia is committed to transparency and Freedom of Speech on the Internet; but called for users to the responsible when using the same. About 100 people attended the Opening ceremony, held at the KDU Law S chool at their new 2 nd campus at Section 13, Petaling Jaya. With KDU recently upgraded to University College status, having the Forum there seemed apt, for the discussion that went on at the Forum was truly educational and informative. Three speakers spoke on the Censorship on Malaysian Internet and all three of them spoke against censorship;...

Keeping it private by Subashini Selvaratnam

The pluses and minuses of the Personal Data Protection Bill 2009 . It is past midnight and you are sleeping soundly. Suddenly, an SMS beeps in. It turns out to be a message from a hotel, which you have never been to in your life, giving away a free one-night st ay. Annoyed, you go back to bed. But you toss and turn. You can't get back to sleep and get even more irritated. Many of us have experienced similar incidents with these unsolicited phone calls, SMSes and e-mail messages. And many have also noticed that these nuisance calls or messages are almost always after they had divulged their personal contact information. It could have been a warranty card you filled up, or you handed over your business card to participate in a "lucky draw" somewhere, or you had just subscribed to some service. In any case, someone either sold your contact information or is misusing it. At the very least, such misuse means you are inconvenienced or irritated by sales pitches. But more worr...

Invitation to serve on the KL Bar Information Technology Committee (ITC)

Dear Members/Pupils, This is a personal invitation from the Information Technology Committee. Last term ITC revamped the KL Bar website and even initiated a Flickr and Twitter account. This is of course, over and above the KL Bar Blog and KL Bar Facebook group, initiated in 2008. This term we are working towards a Telecommunications Collaboration with DIGI, and also to collaborate further with the Publications Committee to post entries on the KL Bar Blog. ITC also aims to create and amplify legal awareness on IT-related Laws. To do that, we wish to organise a mini-Law Conference on IT Law, and hold Forums. In addition, the Court Administration has indicated that IT usage for administration matters will likely increase. It is possible that Court processes like filing or sending letters, may go on-line. ITC will likely be involved in this, if called upon by the Courts. As such, we need help. We need lawyers who can support and assist in the proposed projects. We hope you would give us a ...
