KLBC Activities Report For December 2024

2 December 2024
The Basics Of Injuctions
Organised by the Young Lawyers & Pupils Committee, this webinar was conducted by Lavinia Kumaraendran and moderated by Vanessa Yeong Yen Zan.

The webinar covered the following areas: 

(i) "Characteristics of Injunctions – Discussion on injunctions as extraordinary remedies used to compel or prevent actions, their swift nature in seeking justice, and distinctions between temporary and permanent orders";
(ii) "Anton Pillar Injunction (Civil Search Warrant) – Insight into the intrusive nature of search orders, their purpose in preserving evidence, and the legal framework governing their issuance, including the case of Anton Pillar v Manufacturing Processes Ltd [1976] ALL ER 779";
(iii) "Conditions for Granting of an Anton Pillar Order – Analysis of key conditions such as establishing a strong prima facie case, demonstrating risk of evidence destruction, and proving the defendant's possession of incriminating evidence";
(iv) "Execution and Supervision of Search Orders – Explanation of the role of supervising solicitors, the responsibilities of the search party, and the legal obligations to ensure fair execution of orders"; and
(v) "Failure to Comply and Setting Aside Orders – Overview of the consequences of non-compliance by defendants, potential contempt of court, and grounds for setting aside Anton Pillar orders, including procedural breaches and lack of full and frank disclosure".
This session provided an in-depth look at the strategic use of injunctions in litigation, equipping participants with essential knowledge on obtaining, and defending against these powerful legal tools.

It was held via Zoom from 3:00pm to 5:00pm. We had 50 participants.


3 to 9 December 2024
LAC Pupil’s Training Batch 120/2024
Organised by the Legal Aid Centre (Kuala Lumpur) (“LAC KL”), the LAC Pupils’ Programs training for Batch 120/2024 was conducted from 3 to 9 December 2024. The training sessions for these programs were conducted at the Bar Council Auditorium, Kuala Lumpur Bar Auditorium and LAC KL training room. The trainers were Kasthuri a/p Krishnan, Selvaraja a/l Chinniah, Teoh Alvare, Morhaneraj a/l Rajakumaran, Terrence Lee Rohui, Tiffany Chin Yee Shuen, Sumitra Devi a/p Krishnan, Zulsyahmi Husaini bin Kamarulzaman, and the representatives from the respective NGO Partners.


5 December 2024 
Courtesy Call With The Chief Justice of Malaysia 
The meeting between the Chief Justice of Malaysia and the Kuala Lumpur Bar Committee (“KLBC”) was held on 5 December 2024 at 3:00pm at the Palace of Justice. Also present at the meeting were the Chief Registrar, Datuk Zamri Bin Haji Bakar, the Registrar of The High Court of Malaya, Puan Nik Nasimah Binti Nik Mohamad, the Director of the Kuala Lumpur Courts, Puan Azura binti Alwi, the Director of e-Court Division, Tuan Harmi Thamri Bin Mohamad @ Shaharudin, the Deputy Director of Information Tecnology Division, Tuan Mohamad Roshidi Bin Rozali, and Special Officers, Tuan Abdullah Siddiq Bin Mohd Nasir, Tuan Nik Muizzuddin bin Nik Muhammad and Tuan Badrul Amin bin Roslan.

The KLBC was represented by the Chairman, Alvin Oh Seong Yew, Honourary Secretary, Nimalan Devaraja who is also the Co-Chairperson of the Civil Practice & Court Liaison Committee (“CPCLC”), the KLBC’s Representative to the Bar Council, Vivek Sukumaran, Co-Chairpersons of the CPCLC, Shugan Raman and S. Saravana Kumar, Executive Director of the KL Bar, Melissa Linda Dass and Executive Officer, Noratikah Shaharudin.

The purpose of the meeting was to address several practice-related issues concerning the Kuala Lumpur Courts and to explore a resolution to the same. The Kuala Lumpur Bar had issued Circular No. 204/2024 dated 12 December 2024 to members setting out the issues which had been discussed during the meeting


5 December 2024
Will, Probate, LA and SEDA
Organised by the Corporate & Conveyancing Practice Committee, this seminar was presented by Selva Balan Sinnan. 

The seminar covered the following areas:-

(i) “What is a Will?”;
(ii) “Provisions of the Wills Act”;
(iii) “Legal requirements for a valid Will”;
(iv) “Petition for Probate and Letters of Administration”
(v) “Challenging a Will”; and
(vi) “SEDA”.

It was held from 2:00pm to 5:15pm at the KL Bar Auditorium. We had 45 participants.


7 December 2024 
Mentorship Afternoon Mixer Kick-Off: The Theory of Legal Practice 
This mentorship programme was organised by the Civil Practice & Court Liaison Committee. The programme was presented by Sanjay Mohanasundram, Yeoh Cho Kheong and Sonia Abraham, and moderated by Kuhan Manokaran. The programme was held at Hash Heritage House, Royal Selangor Club from 10:00am to 12:00pm. We had 23 participants.

This Mentorship programme aims to offer young practitioners, who are passionate in legal practice, an opportunity to meet and gain insights from mentors from differing areas of practice and firms, in a casual, intimate and friendly setting.


8 December 2024
Human Rights Day 2024
Organised by the Bar Council Human Rights Committee, the Legal Aid Centre (Kuala Lumpur) (“LAC KL”) was invited to take part in this event, which was held on 8 December 2024 at Mytown Cheras from 3:00pm to 8:00pm. LAC KL set up an open booth, where pamphlets were distributed, and advice was provided to those in need. A total of 40 people visited the booth. Pupils, Adelyn Low Yuet Xin and Nursyibra Salma Binti Che Rahim, assisted in the event.


10 December 2024
Basics Of Judicial Review 
Organised by the Young Lawyers & Pupils Committee, this webinar was conducted by Kee Hui Yee and moderated by Dharshini Sharma.

The webinar covered the following areas:

(i) "Introduction to Judicial Review – Explanation of judicial review as a process of judicial control over administrative actions, focusing on supervisory jurisdiction over decisions by inferior courts, tribunals, and public authorities. Key case references such as Ahmad Jefri bin Mohd Jahri v Pengarah Kebudayaan & Kesenian Johor & Ors [2010] 3 MLJ 145 were discussed";
(ii) "Judicial Review vs Other Modes of Redress – Examination of situations where judicial review may or may not be the appropriate remedy, and the possibility of converting proceedings";
(iii) "Rules of Court 2012, Order 53 – Breakdown of the procedural rules governing judicial review applications, including form requirements, scope of reliefs, and timelines";
(iv) "Locus Standi – Analysis of the “adversely affected” test under Order 53, Rule 2(4), with case references such as QSR Brands Bhd v Suruhanjaya Sekuriti & Anor [2006] 3 MLJ 164 and Malaysian Trade Union Congress v Menteri Tenaga, Air dan Komunikasi [2014] 3 MLJ 145";
(v) "Grounds for Judicial Review – Overview of grounds such as illegality, irrationality, procedural impropriety, and proportionality, with examples from recent case law";
(vi) "Procedure and Time Limits – Insight into the application process, including leave requirements, extensions of time, and the need for prompt action within three months"; and
(vii) "Reliefs and Remedies – Detailed coverage of prerogative orders (mandamus, certiorari, prohibition, quo warranto) and their applications, along with discussions on declaratory reliefs and injunctions against public authorities.
This comprehensive session equipped participants with the foundational knowledge necessary to navigate judicial review proceedings effectively".

It was held via Zoom from 3:00pm to 5:00pm. We had 44 participants. 


12 December 2024
An Introduction To Venture Capital Term Sheets
Organised by the Corporate & Conveyancing Practice Committee, this seminar was presented by Izwan Zakaria and moderated by Wong Kar Ling.

The seminar covered the following areas:-

(i) "Overview of the VC industry’s landscape in Malaysia";
(ii) "Overview of a VC investment term sheet";
(iii) "Common terms and clauses (valuation, equity, governance, and liquidation preferences)";
(iv) "Rights and obligations of investors and founders";
(v) "Key negotiation points and how to protect client’s interests"; and
(vi) "Practical tips for reviewing and drafting VC term sheets based on local practices".

It was held from 2:30pm to 4:30pm at the KL Bar Auditorium. We had 49 participants.

LAC Pupils Program Batch 119/2024 Exit Evaluation
Organised by the Legal Aid Centre (Kuala Lumpur) (“LAC KL”), the Exit Evaluation for Batch 119/2024 was conducted on 12 December 2024 from 9:00am to 1:00pm by Kenneth Koh Zhong Wey. It was held at the Bar Council Auditorium, Level 2, Wisma Badan Peguam Malaysia.

Pupils Introduction and Diversity & Inclusion Session
The Pupils Introduction Session, jointly organised by the Young Lawyers & Pupils Committee and the Gender Equality & Diversity Committee, was held on 12 December 2024 at the Kuala Lumpur Bar Auditorium. This event, led by Ooi Jia Liang, was conducted in two sessions to accommodate participants: a morning session from 9:00am to 12:00pm and an afternoon session from 2:30pm to 5:30pm. A total of 191 pupils attended the event.

The primary purpose of the Pupils Introduction Session was to familiarise pupils with the structure and roles of the Malaysian Bar and the Kuala Lumpur Bar. The session covered key topics such as the elections to the Bar Council and the Kuala Lumpur Bar Committee, as well as the highlights of the Malaysian Bar’s initiatives. Participants were also provided a platform to discuss challenges and issues encountered during their pupillage, fostering an environment of shared learning and support.

A special segment titled “Diversity & Inclusion: Unconscious Bias”, conducted by Tay Kit Hoo, was another highlight of the event. This segment aimed to educate and create awareness about the impact of unconscious biases and innate prejudices on decision-making. The session emphasised how these biases could lead to unintentional discrimination and hinder the development of effective diversity and inclusion practices in the workplace.

The Pupils Introduction Session remains a cornerstone event, equipping future legal professionals with crucial insights, fostering meaningful discussions, and promoting the values of inclusivity and diversity within the legal fraternity.


16 and 27 December 2024 
Pupils Admission To The Bar Briefing
The Pupils Admission to the Bar Briefings were held at the Kuala Lumpur Bar Auditorium on 16 December 2024 and 27 December 2024. The first session, led by Ooi Jia Liang, took place from 12:30pm to 1:30pm and was attended by 60 pupils. The second session, also conducted by Ooi Jia Liang, was held from 11:00am to 12:30pm and was attended by 50 pupils.

LAC Pupils Program Batch 119/2024 Exit Evaluation
Organised by the Legal Aid Centre (Kuala Lumpur) (“LAC KL”), the Exit Evaluation for Batch 119/2024 was conducted on 17 December 2024 from 9:00am to 1:00pm by Joachim Xavier. It was held physically at the Bar Council Auditorium, Level 2, Wisma Badan Peguam Malaysia.
