Principles Of Trust Hibah According To Syariah Regulatory And The NLC
Organised by the Professional Development Committee, this webinar was presented by Murshidah Mustafa.

The webinar covered the following areas:

(i) “What is a Trust?” – Definition, purpose, and components of a trust (settlor, trustee, and beneficiary);
(ii) “What is Hibah?” – Understanding Hibah as a gift under Islamic law and its components (giver, recipient, property, and offer/acceptance);
(iii) “Trust & Hibah” – Principles and the formation of Trust Hibah through Hibah and Trust contracts;
(iv) “Drafting Syariah-compliant documents” – Ensuring compliance with Islamic law and the National Land Code;
(v) “Legal frameworks and disputes” – Key case laws such as Abu Bakar Mohd Isa v. Rosnani Awang (2016), and the interplay between civil and Syariah courts;
(vi) “Applications of Trust Hibah” – Practical steps for estate planning to avoid disputes and ensure proper asset distribution during a lifetime.

It was held via Zoom from 2:30pm to 4:30pm. We had 61 participants.

The Basics Of Conveyancing Practice

Organised by the Young Lawyers & Pupils Committee, this webinar was conducted by Michael Leow and moderated by Nuramira Syahida Mazlan.

The webinar covered the following areas:-

(i) “Parties to a Conveyance” – Identification of key parties involved, including natural persons, corporations, developers, trustees, financial institutions, and government agencies, along with required documentation;
(ii) “Documents for Sale and Purchase” – Overview of sale and purchase agreements, transfer instruments, and tax exemption forms, including variations for properties with and without individual titles;
(iii) “Loan Documentation” – Details of loan or facility agreements for properties with or without titles, including specific requirements under Islamic banking;
(iv) “Registry of Titles/Land Office Procedures” – Insights on title searches, applications for consent, and registration of transactions like transfers and charges;
(v) “Stamp Duty and Real Property Gains Tax (RPGT)” – Guidelines on stamp duty exemptions and RPGT filings for property transactions;
(vi) “Timelines and Authorisations” – Importance of adhering to deadlines, obtaining necessary consents, and ensuring clear communication and documentation between parties;
(vii) “Legal Compliance and Updates” – Importance of staying informed on statutory requirements, government circulars, and relevant case laws for effective conveyancing practice.

It was held via Zoom from 3:00pm to 5:00pm. We had 107 participants.

Legal Awareness Campaign for School Students – SMK Seri Titiwangsa, KL

The legal awareness campaign organised by The Bar Council Legal Aid Centre (Kuala Lumpur) (“LAC KL”) aimed to educate school students about Malaysian laws and how these laws may impact them in the event of any wrongdoing. The outreach session took place at Sekolah Menengah Kebangsaan (SMK) Titiwangsa from 8:30am to 10:00am. Various crucial topics were covered, including bullying, driving or riding without a license, sexual harassment, and smoking at school. The speaker for this session was Mohd Radzlan Bin Jalaludin, with assistance from volunteer pupils in chambers Ahmad Badri Bin Mustaffa and Nur Ainun Nazurah Binti Samril.

YLPC Wellness: Hiking @ Sri Bintang Hill

Organised by the Young Lawyers & Pupils Committee, this hike was held on 10 November 2024 at Sri Bintang Hill. It was held from 8:00am to 10:00am and was attended by 33 participants.



11 and 22 November 2024
Pupils Admission To The Bar Briefing

The Pupils Admission to the Bar briefings were held at the Kuala Lumpur Bar Auditorium on 11 November 2024 and 22 November 2024. The first session, led by Ooi Jia Liang, took place from 11:00am to 12:00pm and was attended by 74 pupils. The second session, was conducted by Tay Kit Hoo from 10:00am to 11:00am and saw the participation of 87 pupils.

Pupils Introduction and Diversity & Inclusion Session

Jointly organised by the Young Lawyers & Pupils Committee and the Gender Equality & Diversity Committee, the Pupils Introduction Session in November was held on 11 November 2024 at the KL Bar Auditorium, Level 4. Led by Ooi Jia Liang, the session was attended by 96 pupils. The purpose of the Pupils Introduction Session is to introduce pupils to the structure of the Malaysian Bar and the Kuala Lumpur Bar, the elections to both the Bar Council and the Kuala Lumpur Bar Committee, and the highlights of the Malaysian Bar. It included a session for students to discuss issues and problems they encountered during their pupillage period.

Also included in the said Pupils Introduction Session was a session on “Diversity & Inclusion: Unconscious Bias”. The aim of this segment is to educate and create awareness about how our unconscious biases and innate prejudices lead to poor judgment and poor decision-making, which in turn result in unintentional discrimination and overall poor "diversity & inclusion" practices in our workplaces. The session was conducted by Tay Kit Hoo.

The Basics of Tax Treatment of Inter-Company Transactions
Organised by the Young Lawyers & Pupils Committee, this webinar was conducted by Abhilaash Subramaniam and moderated by Anishaa Sundramoorthy.

The webinar covered the following areas:

(i) “Basics of Income Tax: Fundamental concepts and the charging provision”;
(ii) “Determination of the origin of income: Place of business and residency rules”;
(iii) “Classes of income: Differentiating income types and their treatment”;
(iv) “Tax treatment of income received in Malaysia from outside Malaysia”;
(v) “Double Tax Agreements: Relief mechanisms and implications”;
(vi) “Fundamental principles of tax: Key legal interpretations and guidelines”;
(vii) “Income vs. capital: Tax implications for transactions and disposals”;
(viii) “Tax treatment on the disposal of shares: Changes effective from 2024”;
(ix) “Inter-company loans: Tax treatment and implications of loan forgiveness”;
(x) “Transfer pricing: Ensuring arm’s length transactions and compliance”;
(xi) “Offences related to tax filings: Penalties and enforcement mechanisms”; and
(xii) “Tax avoidance, evasion, and planning: Legal boundaries and case studies”.

It was held via Zoom from 3:00pm to 5:00pm. We had 85 participants.

Bar Council Legal Aid Centre Kuala Lumpur (“LAC KL”) Pupils Orientation for Compulsory Legal Aid Duty Batch 120/2024
The orientation for pupils of Batch 120/2024 was facilitated by Morhaneraj Rajakumaran on 12 November 2024 from 9:00am to 1:00pm at the Bar Council Auditorium. A total of 144 pupils attended the orientation.

Organised by the Professional Development Committee, this webinar was presented by Vince Tan Hoo Seh.

The webinar covered the following areas:

(iii) “COVID-19 Pandemic: Impact on employment, SMEs, and income disparity”;
(iv) “Post-COVID-19 Economic Recovery: Challenges and shifts in the labour market”;
(v) “Legislative Reforms: Recent amendments to employment laws and their implications”;
(vi) “Corporate Governance: ESG and business-human rights frameworks”;

It was held via Zoom from 2:30pm to 4:30pm. We had 33 participants.

Bar Council Legal Aid Centre Kuala Lumpur (“LAC KL”) Pupils Orientation for Compulsory Legal Aid Duty Batch 120/2024

The orientation for pupils of Batch 120/2024 was facilitated by Joachim A/L Francis Xavier on 13 November 2024 from 9:00am to 1:00pm at the Bar Council Auditorium. A total of 147 pupils attended the orientation.

This seminar was organised by the Civil Practice & Court Liaison Committee. The seminar was presented by Justice Ong Chee Kwan, Brendan Siva and Cindy Goh Joo Seong and moderated by Aarthi Jeyarajah. The seminar was held at the Kuala Lumpur Bar Auditorium from 4:00pm to 6:00pm. We had 74 participants.

5th Kuala Lumpur Bar V Malacca Bar Series 2024

The 5th series between the Kuala Lumpur Bar and the Malacca Bar for the R. Ponnudurai Challenge Trophy was held at the Rotunda Malacca Club, Jalan Tanjung Kling, Tanjung Kling, Melaka on 16 November 2024. The Malacca Bar hosted the series this year.

Four sports were played namely Ladies Futsal, Badminton, Darts, and Snooker.

The Kuala Lumpur Bar emerged as the overall winner in this series. The results were as follows:-








The dinner was held at The Malacca Club, Rotunda, Malacca and was well attended by the participants from both Bars.

Organised by the Corporate & Conveyancing Practice Committee, this webinar was presented by Jane Guan and moderated by Samuel Ong Ying Yie.

The webinar covered the following areas: -

(iii) “Market definition”;
(iv) “Anti - competitive agreements:
      a. Cartel
      b. Information exchange
      c. Vertical restraints”;

It was held from 2:30pm to 4:30pm via Zoom. We had 48 participants.

The Bar Chronicles Series 2 - The Human Library

Organised by the Gender Equality & Diversity Committee, the event was held on 19 November 2024 at Kuala Lumpur Polo Club, 1 Lorong Kelab Polo DiRaja, 55000 Kuala Lumpur Malaysia from 7:30pm to 9:30pm. This event was presented by Sheena Gurbakhash, Datin Raja Riza Shazmin, and Norliza Binti Rasool Khan. We had 23 participants.

After Work Social

The After Work Social took place on 22 November 2024 at the Pavilion, Royal Lake Club, Kuala Lumpur. Approximately 60 participants attended the event.

KL Bar Deepavali Charity Event

The Deepavali Celebration took place on 23 November 2024, from 11:00 am to 2:00 pm, at Karunai Illam, located at Taman Ehsan, Kuala Lumpur. We collected a cash donation of RM2,871.00.

The KL Bar collaborated with MTMT Studios to organise an art-based empowerment activity for the children. We also provided lunch for the children and donated three standing fans and a selection of household items, including kitchen utensils and hygiene products, to support Karunai Illam's daily needs. The children also received ang pows.

The Basics Fundamentals And Principles Of Medico-Legal Disputes

Organised by the Young Lawyers & Pupils Committee, this webinar was conducted by Tishondra Puspanathan and moderated by Genevieve Bridie Vanniasingham.

The webinar covered the following areas:

(i) “Legislation and statutes: Including the Medical Act 1971, Private Healthcare Regulations, and the Mental Health Act 2001”;
(ii) “Basics of medical negligence: Exploring cases like Bolam v Friern Hospital and Rogers v Whitaker”;
(iii) “Fundamentals: Addressing the right to privacy, data protection, and potential legal actions under negligence, trespass, and the Penal Code”;
(iv) “Legal principles: Understanding the duty of care, standard of care, and causation in medical cases”;
(v) “Standard of care: Highlighting landmark judgments such as Montgomery v Lanarkshire Health Board (2015)”;
(vi) “Causal link: Discussing the ‘but for’ test and material contribution in determining causation”;
(vii) “Redress for the injured party: Including general and special damages, aggravated and exemplary damages, and statutory compensation”; and
(viii) “Available defenses: Such as therapeutic privilege and professional judgment.”.

It was held via Zoom from 3:00pm to 5:00pm. We had 42 participants.

Advanced Training Workshop – Armada Hotel, Petaling Jaya

The Bar Council Legal Aid Centre (Kuala Lumpur) held an Advanced Training Workshop at Armada Hotel, PJ, from 8:30am to 8:30pm. The sessions, which covered key legal topics, featured the following speakers: Collin Arvind Andrew, Abang Mohd Iwawan Bin Abg Narawi @ Abg Nawawi, Ravinder Singh Dhalliwal, Harleen Kaur A/P Tarjeet Singh, and Joachim A/L Francis Xavier.

Facilitators Navina A/P Ramani, Aradhna Kaur A/P Jasbeer Singh, and Melissa Chua Su Lynn guided the participants through the sessions. Morhaneraj Rajakumaran gave the welcome remarks, setting the tone for the day. Volunteer pupils for this program included Adelyn Low Yuet Xin, Manesh Kalai Selvan, and Ahmad Hafizulakbar Bin Hashim.

A total of 50 people attended the workshop. The day ended with a networking dinner, where participants mingled with senior lawyers, gaining insights and building connections. It was a productive and enriching day for everyone involved.
