3 & 4 October 2024
Yayasan Bantuan Guaman Kebangsaan (YBGK) Training for Lawyers (Part 3)
The Bar Council Legal Aid Centre (Kuala Lumpur) (“LAC KL”),organised Part 3 of the YBGK training which focused on Criminal Trial Advocacy. It was held at the LAC KL Training Room, Level 3 WBPM. The training was conducted by Collin Andrew from 9:00am to 5:00pm. 14 lawyers attended the training.

Legal Awareness Program – Rumah Ozanam, Petaling Jaya

The legal awareness campaign organised by the Bar Council Legal Aid Centre (Kuala Lumpur) (“LAC KL”) is designed for school students with the aim to educate them about Malaysian laws and the manner in which the laws may impact them in the event of any wrongdoing. The outreach session took place at a shelter home, Rumah Ozanam located at Petaling Jaya, from 9:30am to 12:30pm.There were various crucial topics covered during this session including bullying, sexual harassment, and fighting at school. The speaker for this session was Morhaneraj Rajakumaran.

Trust For Estate Planning

Organised by the Professional Development Committee, this Seminar was conducted by KC Lim.

The Seminar covered the following areas:-

(i) “What is a trust?”;
(ii) “How is trust used in estate planning?”;
(iii) “What is beneficial ownership?”;
(iv) “What is the difference between Last Will & Testament and Trust, including Living Trust?”;
(v) “What is purpose of the creator and/or adviser of Last Will & Trust and Trust?”;
(vi) “Which is better? Last Will & Testament or Trust or both?”;
(vii) “What is express trust?”;
(viii) “How is an express trust created?”;
(ix) “How is living trust created?”;
(x) “What is a settlement?”;
(xi) “What is a declaration of trust?”;
(xii) “What is the difference between settlement and declaration of trust?”;
(xiii) “What are the key ingredients in settlement and declaration of trust?”;
(xiv) “How to create testamentary trust?”;
(xv) “What are examples of testamentary trust?”; and
(xvi) “What other incidentals relevant to trust.”

It was held at Kuala Lumpur Bar Auditorium from 9:30am to 4:30pm. We had 99 participants.

Legal Awareness Program – SMK Tiara Permai, KL

The legal awareness campaign organised by the Bar Council Legal Aid Centre (Kuala Lumpur) (“LAC KL”) is designed for school students with the aim to educate them about Malaysian laws and the manner in which these laws may impact them in the event of any wrongdoing. The outreach session took place at Sekolah Menengah Kebangsaan (“SMK”) Tiara Permai from 8:00am to 10:00am. There were various crucial topics covered during this session including bullying, driving or riding without a license, sexual harassment, and smoking at school. The speaker for this session was Manimagalai a/p Gowindasamy.

Pupils Call Briefing

Organised by the Young Lawyers & Pupils Committee, the briefing for the Pupils Admission to the Bar was held on 14 October 2024, from 11:00am to 12:00pm. The briefing was conducted by Ooi Jia Liang and was attended by 84 pupils at the Kuala Lumpur Bar Auditorium.

Pupils Introduction and Diversity & Inclusion Session

Jointly organised by the Young Lawyers & Pupils Committee and the Gender Equality & Diversity Committee, the Pupils Introduction Session in October was held on 14 October 2024 at the KL Bar Auditorium, Level 4. Led by Ooi Jia Liang, the session was attended by 89 pupils. The purpose of the Pupils Introduction Session is to introduce pupils to the structure of the Malaysian Bar and the Kuala Lumpur Bar, the elections to both the Bar Council and the Kuala Lumpur Bar Committee, and the highlights of the Malaysian Bar. It included a session for students to discuss issues and problems they encountered during their pupillage period.

Also included in the said Pupils Introduction Session was a session on “Diversity & Inclusion: Unconscious Bias”. The aim of this segment is to educate and create awareness about how our unconscious biases and innate prejudices lead to poor judgment and poor decision-making, which in turn result in unintentional discrimination and overall poor "diversity & inclusion" practices in our workplaces. The session was conducted by Brenda Rangithan.

Seoul Bar Association Visit

The Kuala Lumpur Bar Committee hosted members of the Seoul Bar Association on 15 October 2024 at the Kuala Lumpur Bar followed by lunch at the Royal Selangor Club. The meeting was attended by the Chairman, Alvin Oh Seong Yew, Honorary Secretary, Nimalan Devaraja, Treasurer, Rajsurian Pillai, Representative to the Bar Council, Vivekananda Sukumaran, and committee members, Shugan Raman and Brenda Rangithan. The Seoul Bar Association were represented by their President Mr. Kim, Jung Wook, their Director of International Affairs, Ms. Ha, Chayeun, and their Director of Ethics, Ms. Kim, Sanghee.

Organised by the Professional Development Committee, this Seminar was conducted by Lim Ming Wang, Foong Cheng Leong and Tong Lai Ling and was moderated by Thulasy Suppiah. It was held at Kuala Lumpur Bar Auditorium from 2:30pm to 4:30pm. We had 43 participants.

The Basics & Key Tenets Of Islamic Finance

Organised by the Young Lawyers & Pupils Committee, this webinar was conducted by Dr. Syed Adam Alhabshi and moderated by Sukhdev Kaur a/p Dalip Singh.

The webinar covered the following areas:-

(i) “Introduction to Islamic Finance: Overview of Shariah compliance and its significance”;
(ii) “Comparison with Conventional Finance: Key differences in principles and objectives”;
(iii) “Contracts in Islamic Banking*: Types such as Murabahah, Ijarah, Mudarabah, and “Wakalah, highlighting unique structures like Tawarruq and Bai’ Inah”;
(iv) “Prohibition of Riba, Gharar, and Maysir: Understanding prohibited elements, including the implications of Riba on transactions”;
(v) “Framework of Shariah Compliance in Malaysia: Role of the Shariah Advisory Council “(SAC) and the Shariah Committee in upholding compliance”;
(vi) “Shariah Rulings and Principles (Fiqh): Sources like Ijma', Qiyas, and Istihsan that inform Islamic finance practices”; and
(vii) “Case Studies and Legislative Overview: Practical applications and the laws governing Islamic banking, including the Islamic Financial Services Act 2013”.

It was held via Zoom from 3:00pm to 5:00pm. We had 44 participants.

Organised by the Corporate & Conveyancing Practice Committee, this webinar was presented by Jeremiah Rais Bin Badrul Hisham.

The webinar covered the following areas: -

(i) “An overview of the Malaysian regulatory framework on cryptocurrencies”;
(ii) “The Securities Commission’s Guidelines and investor protection; and
(iii) “Anti-money laundering measures and cryptocurrencies”.

It was held via Zoom from 3:00pm to 4:30pm. We had 80 participants.
