VIRTUAL CRIMINAL LAW CONFERENCE 2021

Organised by the Criminal Law Practice Committee (“CLPC”), this conference was held via Zoom on 13 and 14 November 2021 with the theme “Criminal Justice - Moving Forward Beyond the Pandemic“. Putri Noor Nasyira binti Ismadi was the emcee for the 2-day conference. The welcome speech was delivered by the Chairman of the Kuala Lumpur Bar Committee, Vivekananda Sukumaran. The President of the Court of Appeal, Yang Amat Arif Tan Sri Rohana Binti Yusuf gave the opening speech via a precorded video.

There were five sessions on 13 November 2021 – Session 1 entitled “Effective Criminal Appellate Advocacy - Perspectives From The Bench” from 10:10pm to 11:45pm was presented by Yang Arif Dato' Abdul Rahman bin Sebli, Yang Arif Datuk Abdul Karim bin Abdul Jalil and Yang Arif Dato Abu Bakar bin Jais and moderated by Kitson Fong. This session was sponsored by Raja S Devan & Veni.


Session 2 entitled “Determining Trafficking And Possession For “Personal Consumption” And Alternative To Incarceration For People Who Use Drugs” from 12:00pm to 1:30pm was presented by Prof. Dr. Vicknasingam Balasingam Kasinather, Assoc. Prof. Dr. Anne Yee Hway Ann and Samantha Chong and moderated by Ho Cheng En.


Session 3 entitled “Forfeiture Of Goods Under Section 128 Of The Customs Act 1967: A Critical Analysis” from 2:30pm to 3:30pm was presented by Datuk Ravendren J C Ramalu and moderated by Datuk Hj Kuthubul Zaman Bukhari.


Session 4 entitled “Forensic Science - Preservation of DNA” from 3:45pm to 4:15pm was presented by Supt. Puan Raihanah Hamdan and moderated by Morhaneraj Rajakumaran.


Session 5 entitled “Gender Equality In Criminal Law Fraternity: Myth Or Truth?” from 4:30pm to 5:45pm was presented by Yang Arif Puan Julia Binti Ibrahim, Puan Zahida Binti Zakaria, Puan Sri Datin Seri N. Saraswathy Devi and moderated by Farhana Binti Abdul Halim.


There were four sessions on 14 November 2021 – Session 6 entitled “Moving Forward- Virtual Criminal Trials In Subordinate Courts” from 10:10am to 11:45am was presented by Tuan Edwin Paramjothy a/l Michael Muniandy, Tuan Mohamad Fared Bin Abdul Latif and Puan Nurshahira Binti Abdul Salim and moderated by Nur A’minahtul Mardiah Bt Md Nor. This session was sponsored by Jeremy Vinesh Anthony & Co.


Session 7 entitled “The Admissibility Of Computer Evidence For The Defence In A Criminal Trial” from 12:00pm to 1:00pm was presented by Assoc Prof Dr. Ramalinggam Rajamanickam and moderated by Daniel Annamalai N. Subramaniam.


Session 8 entitled “Advocacy In Sexual Offences Trials And Defences Rarely Used In Malaysia” from 2:00pm to 3:00pm was presented by Salim Bin Bashir Bhaskaran, Datuk Wan Azmir Bin Wan Majid and moderated by Putri Noor Nasyira binti Ismadi.


Session 9 entitled “White Collar Crimes - Discussion On Corporate Criminal Liability And Forfeiture Proceedings” from 3:15pm to 4:45pm was presented by Dato’ K. Kumaraendran and Amer Hamzah Bin Arshad and moderated by Purshotaman Puvanendran. This session was sponsored by AmerBON.


The conference concluded with a closing speech from the Chairperson of the CLPC, Collin Arvind Andrew. We had 150 participants including the sponsored and complimentary seats.

PUPILS INTRODUCTION SESSION - DIVERSITY & INCLUSION SESSION

The Pupils Introduction Session in November was held online via Zoom from 2:30pm to 5:30pm. Led by Rajsurian Pillai, the session was attended by 67 pupils. The purpose of the Pupils Introduction Session was to introduce pupils to the structure of the Malaysian Bar and the Kuala Lumpur Bar, the election to both the Bar Council and the Kuala Lumpur Bar Committee (“KLBC”) and the highlights of the Malaysian Bar. It included a session for pupils to raise issues and problems faced by them during their pupillage period.

Also included in the said Pupils Introduction Session was a session on “Diversity & Inclusion” which aim was to educate and create awareness among the pupils on, inter alia, issues related to gender sensitisation, sexual harassment and unconscious bias. The session was by Thulasy Suppiah, Chairperson of the Gender Equality & Diversity Committee.

MEETING WITH THE DIRECTIOR OF THE KUALA LUMPUR COURTS
The meeting with the Director of the Kuala Lumpur Courts was held on Tuesday, 23 November 2021 at 10:00am at Bilik Anggerik, Level 6, Kuala Lumpur Court Complex. Also present at the meeting was a representative from Department of Director General of Lands & Mines Federal, Tuan Ganesan. The Kuala Lumpur Bar Committee was represented by the Chairman, Vivekananda Sukumaran, the Honourary Secretary, Alvin Oh Seong Yew, the Chairperson of Civil Practice & Court Liaison Committee, Nimalan Devaraja and the Chairperson of the Criminal Law Practice Committee, Collin Arvind Andrew.

The main issue discussed was the status of the car park outside the Kuala Lumpur Court Complex and the maintenance of the area.
