KLBC Activities Report for August and September 2019

Pupils Dining: Taste Of The Bar VIII
Organised by the Pupils Committee, this event was held at the Grand Ballroom, Royal Selangor Club (Dataran) from 6:30 pm to 10:30 pm. Intended to give pupils an opportunity to spend an evening interacting with senior members of the Bar and/or Judges who have wide experience in the legal profession, the event was graced by retired Judges Dato’ Mah Weng Kwai, Dato’ Seri Mohd Hishamudin Yunus and Dato’ John Louis O'Hara and 17 senior members of the Bar namely, Lee Tatt Boon, Honey Tan, Atan Mustaffa, Goh Siu Lin, M. Visvanathan, Saha Deva, Richard Wee, Fahri Azzat, K Shanmuga, H.R. Dipendra, Thayananthan Baskaran, Puteri Shehnaz, Harleen Kaur, Foong Cheng Leong, Saravana Kumar, Khaizan Sharizad and Kenny Lai Choe Ken. A total of 79 pupils and young lawyers attended.

Sponsored Construction Law Seminar: Variations And Their Valuation In Construction Contracts
Organised by the Professional Development Committee and sponsored by Kheng Hoe Advocates, this seminar was presented by Chan Kheng Hoe at the KL Bar Auditorium from 3:00 pm to 6:00 pm. The seminar was attended by 40 participants and covered, amongst others, "Nature of variations”; “Power to order variations"; "Mounting a variation claim"; "Under what circumstances are variations arising from sites conditions - who bears the risk?"; "How to value positive variations?"; "How to value variations in the form of omissions?"; and "Effect of variations on preliminaries."

Blood Donation Campaign
The Annual Blood Donation Campaign, organised with the assistance of the National Blood Bank, was held at Level 2 of the Kuala Lumpur Court Complex at Jalan Tuanku Abdul Halim. Members of the Bar, Court staff and members of the public nobly came forward to participate in this Blood Donation Campaign.

A total of 45 donors registered. Unfortunately, only 36 were eligible to donate. The 9 were rejected because they were either underweight, having high blood pressure or low blood pressure or had lived in the United Kingdom from 1980 till 1996 or in Europe between 1980 until the present.  A total of 36 units of blood were collected from the caring donors.

Seminar on The Basics Of Cross Examination In Civil And Commercial Trials
Organised by the Professional Development Committee, this seminar was presented by Brendan Navin Siva and Shamuga Kanesalingam at the KL Bar Auditorium from 3:00 pm to 5:30 pm. The seminar was attended by 94 participants and covered, amongst others, "The objective and purpose of cross-examination"; "The nature of cross-examination in civil and commercial matters"; and "Practical tips for young lawyers".

Pupils Introduction Session
A monthly tradition, the August’s Pupils Introduction Session was held on 21 August 2019. The session, led by Rajsurian Pillai, was attended by 97 pupils. The purpose of the Pupils Introduction Session is to introduce pupils to the structure of the Malaysian Bar and the Kuala Lumpur Bar, the election to both the Bar Council and the Kuala Lumpur Bar Committee (“KLBC”) and the highlights of the Malaysian Bar. It included a session for pupils to raise issues and problems faced by them during their pupillage period. The other members of the KLBC were also present to provide input and possible solutions.

Also included in the Pupils Introduction Session was a session on “Diversity & Inclusion” which aim was to educate and create awareness among the pupils on, inter alia, issues related to gender sensitisation, sexual harassment and unconscious bias. The session was conducted by Nik Shazarina of Sisters in Islam and Goh Siu Lin.

Sponsored Tax Seminar: Managing Tax Issues In Financial Transactions
Organised by the Professional Development Committee and sponsored by Lee Hishammuddin Allen & Gledhill, this seminar was presented by S. Saravana Kumar and Ong Eu Jin at the KL Bar Auditorium from 3:00 pm to 5:30 pm. The seminar was attended by 38 participants.

        Interstate Bar Games (“ISBG”) 2019
         Hosted by the Pahang Bar Committee, the Interstate Bar Games this year was held in 
         Kuantan. 10 sports were competed in the ISBG and the Kuala Lumpur Bar emerged the
         Overall Champion, edging out Selangor Bar (29 points to 26 points).

Meeting At IPD Dang Wangi
The meeting between Criminal Law Practice Committee (“CLPC”) and the OCPD of IPD Dang Wangi was held at Level 4, IPD Dang Wangi at 3:00 pm. The CLPC was represented by the CLPC Chairperson, Jacky Loi and CLPC member, Nur A’minahtul Mardiah. The two main issues raised with the OCPD were, (1) private lawyers not being allowed into the lockup area to conduct remand hearings; and (2) difficulties for lawyers representing arrested suspects to get information. Organised by the Professional Development Committee, this seminar was presented by Syahredzan Johan at the KL Bar Auditorium from 3:00 pm to 6:00 pm. The seminar was attended by 26 participants.

Seminar on Wills, Probate, LA And SEDA
Organised by the Corporate and Conveyancing Practice Committee, this seminar was presented by Nahzatul Ain, Sarah Kambali, Daphne Lew Chah Yee and Selva Balan Sinnan at the KL Bar Auditorium from 10:00 am to 4:30 pm. The seminar was attended by 83 participants and covered, amongst others, "The Basic Concept and Fundamental of Writing a Will"; "Determining the Mode of Application"; "Processes for obtaining Probate or Letters of Administration of An Estate of a Person, and Small Estate"; and "Its Relevance with Conveyancing Practice".

Workshop on An Introduction To Drafting Pleadings In Joint Petition For Divorce
Organised by the Professional Development Committee, this workshop was presented by Honey Tan Lay Ean and Matt Wong Chong Ee at the KL Bar Auditorium from 9:00 am to 5:00 pm. The seminar was attended by 16 participants. The aim of the workshop was to improve the participants’ drafting skills in this area of law.

Seminar on An Introduction To Employment Law
Organised by the Professional Development Committee, this seminar was presented by Corrine Chin and Tan Su Ning at the KL Bar Auditorium from 3:00 pm to 5:00 pm. The seminar was attended by 30 participants and covered, amongst others, "Introduction to Employment Act 1955"; "To differentiate between the Employment Act and Non-Employment Act employees"; "Minimum statutory benefits"; "The Law of Unjust Dismissal"; "Redundancy and Retrenchment"; "Poor Performance"; "Misconduct"; and "Unjust Dismissal Claim Procedure".

Lawyers And Lattes: Navigating The Waves Of Practice
Organised by the Young Lawyers Committee, this event aimed to give young members of the Bar an opportunity to get up-close with the speakers in a casual setting. Held at Mona @ Publika from 11:30 am to 2:30 pm, the event was attended by 33 participants and graced by 4 speakers namely Tan Swee Im, Alex Anton Netto, Aaron Matthews and Dr Syed Adam.

Organised by the Professional Development Committee, this seminar was presented by Lee Shih and Nathalie Ker Si Min at the KL Bar Auditorium from 3:00 pm to 6:00 pm. The seminar was attended by 32 participants.

Conveyancing Workshop For Pupils
Organised by the Pupils Committee, this workshop was conducted by Michael Leow Yon Meng at the KL Bar Auditorium from 3:00 pm to 5:30 pm. Attended by 84 participants, the workshop focused primarily on the practical aspects of handling a brief covering the following areas, "Overview of the conveyancing process"; "Essential clauses found in a Sale & Purchase Agreement"; "How to fill out the relevant NLC Forms"; and "Practical pointers for the conveyancing lawyer".

Seminar on What Are The Statutory Duties Of Developer / JMB / MC?
Organised by the Corporate & Conveyancing Committee, this seminar was presented by Lai Chee Hoe at the KL Bar Auditorium from 2:30 pm to 5:30 pm. The seminar was attended by 79 participants and covered, amongst others, "Duties of Developer (DMP)"; "Powers of Developer (DMP)"; "Duties of JMB"; " Powers of JMB"; "Duties of Developer (PMP)"; "Powers of Developer (PMP)"; "Duties of MC"; and "Powers of MC".

28th “Sports Carnival” – Kuala Lumpur Bar Vs Royal Selangor Club
The Royal Selangor Club (“RSC”) played host in this year’s Series. Nine sports were competed the Series and Kuala Lumpur Bar (“KL Bar”) and RSC emerged tie champion for the YA Tan Sri Dato’ Harun Hashim Challenge Trophy. The results were as follows:

KL Bar-Lincoln’s Inn Alumni Moot Court Competition 2019
An inaugural project, this competition was co-organised by the Young Lawyers Committee and the Honourable Society of Lincoln's Inn Alumni Association Malaysia and held at the Kuala Lumpur Court Complex. The aim of the competition was to provide law students with the experience of making an argument in an actual court setting. Nine teams from public and private universities participated in this competition and the results were as follows: The Champions were Team 1901 from Advance Tertiary College (Kuala Lumpur), 1st Runner Up was Team 1902 from University Malaya, Best Oralist was Subash Jai Devaraj from Advance Tertiary College (Kuala Lumpur) and Best Team Written Submissions were Team 1903 from University Utara Malaya.
