KLBC Activities Report for May 2018

Seminar on The Malaysian Judiciary and the Doctrine of the Basic Structure of the Constitution 
Organised by the Professional Development Committee, this seminar was presented by Dato’ Seri Mohd Hishamudin Yunus at the KL Bar Auditorium from 2:30 pm to 5:30 pm. The seminar was attended by 18 participants. The lecture discussed the doctrine of the basic structure of the Constitution as propounded by the Supreme Court of India in the landmark case of Kesavananda Bharati v State of Kerala (1973). It also discussed the initial reluctance of the Federal Court to adopt the principle in Loh Koi Choon (1977); and the gradual acceptance of that principle in subsequent cases. Among the other cases that were discussed were Sivarasah Rasiah (2010), Semenyih Jaya (2017) and Indra Gandhi (2018).

Seminar on Civil Procedure 
Organised by the Professional Development Committee, this seminar was presented by Selva Balan Sinnan at the KL Bar Auditorium from 3:00 pm to 6:00 pm. The seminar was attended by 28 participants and covered, amongst others, "Case Management"; "Litigation/Caseload Management"; "Document Management (Enclosures/Cause Lists/E-Filing)"; "Conduct of Proceedings (Issues with Applications, Appeals, Submissions, Preparation of Orders, Service Practice Direction Compliance)"; "Exception Handling (Urgencies/Delays, Adjournments, Witnesses, Irregularities and Non-Compliances)"; "Interactions with Courts/Opponents/Clients, and other matters that may not be immediately obvious to Unacquainted Court Practitioners".

6th KL Bar Futsal Tournament 2018
This Tournament was held at Samba De Futsal, Petaling Jaya on 5 May 2018. A total of 27 teams (24 Men’s and 3 Women’s) participated in the event and the results were as follows:

Seminar on The Personal Data Protection Act 
Organised by the Professional Development Committee, this seminar was presented by Jeremiah R. Gurusamy at the KL Bar Auditorium from 2:00 pm to 4:00 pm. The seminar was attended by 32 participants and covered, amongst others, “Introduction to the Malaysian Personal Data Protection Act (PDPA) 2010”; “ PDPA Compliance”; “Dealing with the 7 Data Principles”; “PDPA Implementation”; and “Ensuring Successful Compliance with the PDPA”.

Seminar on The New Companies Act 2016 and the Companies Winding Up Petitions: An Introduction
Organised by the Professional Development Committee, this seminar was presented by Alex Chang at the KL Bar Auditorium from 1:30 pm to 4:30 pm. The seminar was attended by 94 participants and covered, amongst others, "New threshold of issuing a Notice Pursuant to s 218  (now 465 and 466) of the new Act"; "Definition of Unable to pay the debts"; "Affidavit Verifying Petition"; "New Commencement of the  Winding Up"; "Twice or four times Advertisement of the Petition in the Newspapers?"; "Affidavit In Opposition to Petition"; "Appointment of an INTERIM Liquidator, Official Receiver or the (Private) liquidator"; "Costs"; "Interpretation by the Federal Court of the word ‘and'  in s 223  of the old  Companies Act 1965, as   ‘disjunctively’ instead of the usual  ‘conjunctively’, and now in light of the new section  467 the Companies Act 2016"; "The ‘Pay Something for Nothing’ proposition"; "How a RM74 million Court Judgment in Damages was reduced to nothing?"; and "The journey of both matters from the High Court all the way to the Federal Court".

Pupils Introduction Session
A monthly tradition, the May’s Pupils Introduction Session was held on 23 May 2018. The session, attended by 99 pupils, was led by Alex Netto. The purpose of the session is to introduce pupils to the structure of the Malaysian Bar and the Kuala Lumpur Bar, the election to both the Bar Council and the Kuala Lumpur Bar Committee (“KLBC”) and the highlights of the Malaysian Bar. It included a session for pupils to raise issues and problems faced by them during their pupillage period. The other executive committee members of the KLBC were also present to provide input and possible solutions.

Also included in the Pupils Introduction Session was a session on “Diversity & Inclusion” which experimental module was launched in the December 2017 Pupils Introduction Session. The session was conducted by Goh Siu Lin.

Corporate Workshop for Pupils 
The Pupils Committee organised a Corporate Workshop specifically for pupils on 30 May 2018 focusing primarily on the practical aspects of handling a brief covering the following areas, "Overview: Negotiation, Due Diligence and Drafting Process"; "Commercial Considerations"; "Practical Pointers including Common Mistakes when Drafting"; "Salient Clauses including Consideration, Conditions Precedent, Completion, etc"; "Covenants and Warranties by both Vendors and Purchasers"; "Boiler Plate Clauses"; and "Remedies for Breach of Contract". 57 pupils attended the Workshop which was conducted by Sheba Gumis.
