Pupils
Introduction Session
A
monthly tradition, the July’s Pupils Introduction Session was held on 5 July
2017. The session, attended by 84 pupils, was led by Alvin Oh. The purpose of
the session is to introduce pupils to the structure of the Malaysian Bar and
the Kuala Lumpur Bar, the election to both the Bar Council and the Kuala Lumpur
Bar Committee (“KLBC”) and the highlights of the Malaysian Bar. It included a
session for pupils to raise issues and problems faced by them during their
pupillage period. The other executive committee members of the KLBC were also
present to provide input and possible solutions. As in previous sessions, the pupils
were also shown a video montage of the History of the Malaysian Bar. A session
on harassment and/or sexual harassment awareness was introduced with the
purpose of educating the pupils on such issues and providing them details on
how to report harassment if they are faced with such behaviour. The session was
conducted by Betty Yeoh, a founder member of AWAM.

Corporate Workshop for Pupils
The KLBC Pupils Committee organised a
Corporate Workshop specifically for pupils on 6 July 2017 focusing primarily on
the practical aspects of handling a brief covering the following areas,
"Overview: Negotiation, Due Diligence And Drafting Process";
"Commercial Considerations"; "Practical Pointers Including
Common Mistakes When Drafting"; "Salient Clauses Including
Consideration, Conditions Precedent, Completion, Etc"; "Covenants And
Warranties By Both Vendors And Purchasers"; "Boiler Plate Clauses";
and "Remedies For Breach Of Contract". 42 pupils attended the
Workshop which was conducted by Addy Herg.

Assertive
Presentation Skills Workshop
Organised
by the Professional Development Committee, this workshop was presented by K. Loghandran,
World Award Winner in Public Speaking, at the KL Bar Auditorium from 9:00 am to
5:00 pm. This one-day high activity workshop aimed at helping lawyers to practise
techniques and acquire a new assertive behaviour in presentations. It also
included a one-hour session in face-to-face adaptability and assertive
negotiation practice with ‘Beat the Peddlers at their game’ in Petaling Street.
14 participants attended this workshop.

Seminar on Gender and Sexuality for Lawyers
Organised by the Gender Equality and Diversity
Committee, this seminar was presented by Thilaga Sulathireh and Aston Paiva at
the KL Bar Auditorium from 2:30 pm to 5:00 pm. The seminar was attended by 8
participants and covered, amongst others, "What is sex, gender identity, gender expression and sexual orientation"; "Key issues and trends"; "Cases - section 66, change of name, gender marker and other details in legal documents, SM case"; and "Good practices".

(Repeat) Seminar on Updates to the Companies Act
Organised
by the Professional Development Committee, this seminar was presented by Wong
Tat Chung at the KL Bar Auditorium from 9:30 am to 12:30 pm. The seminar was
attended by 114 participants. The seminar covered the Companies Act 2016: The
after effects and the relevant subsidiary legislation.

Seminar on Registration of Foreign Marriages & Divorces
of Malaysians; Is Registration a Requirement for Validity of a Malaysian
Marriage and Dependency Claims
Organised
by the Professional Development Committee, this seminar was presented by Balwant
Singh Sidhu at the KL Bar Auditorium from 3:00 pm to 6:00 pm. The seminar was
attended by 49 participants. This Seminar covered all the relevant provisions
of the Law Reform (Marriage & Divorce) Act 1976, that is the Application of
the Act (Section 2); Domicile; Solemnisation of Marriages (Sections 22 to 24);
Solemnisation of Marriages abroad (Section 26); and the whole of Part IV of the
Act, which covers registration of marriages, and particularly Section 34 (Legal
effect of Registration). It also discussed the Articles “Married or Not Married
– That is the Question (2002) 3 MLJ cxxix” and “The Need to Amend Section 107
of the Law Reform (Marriage & Divorce) Act 1976 (2009) 4 MLJ (cxxiv)” and
also generally cases on dependency claims which have touched on the marital
status of the parties.

Sexual Harassment Awareness Training Workshop
Organised
by the Young Lawyers Committee, this workshop was presented by Yu Ren Chung and
Daniella Zulkifili at the KL Bar Auditorium from 10:00 am to 1:00 pm. The
seminar was attended by 29 participants and covered, amongst others, "Definition of sexual harassment"; "Types of sexual harassment"; "Legal framework dealing with sexual harassment in the workplace"; "The different types of recourse and practical solutions available to victims of sexual harassment"; and "Barriers to reporting sexual harassment and ways to overcome them".

Seminar on The Acquisition & Disposal of Shares in Real Property
Company
Organised
by the Professional Development Committee, this seminar was presented by Lim
Kien Chai at the KL Bar Auditorium from 9:00 am to 5:00 pm. The workshop was
attended by 62 participants. The seminar covered, amongst others, "Revisit
the business strategy of using RM2.00 paid-up company to buy and/or keep real
property"; "What is Share sale in the context of a property
investment company?"; "How does it differ from Asset sale by a
property investment company?"; "What & how to determine Real
Property Company (RPC)?"; "How do you determine the price of the
shares of RPC?"; "Valuation of a RPC?"; "How to
differentiate chargeable gains accruing from the disposal of real property
assets from the disposal of real property shares of a RPC?"; "How to
differentiate real property transactions resulting in chargeable gain or

Meeting with the Wilayah Land Office together with Bar Council re
E-Tanah
The Corporate & Conveyancing Practice Committee (“CCPC”) initiated a
helpdesk (via email) to vet the urgent cases on behalf of the Wilayah Land
Office. Titles that required urgent conversion was compiled and forwarded to
the Wilayah Land Office on a daily basis.
As a follow-up to the above exercise, a meeting with the Wilayah Land
Office was held on 18 July 2017 which was attended by the CCPC as well as
representatives from the Bar Council and Selangor Bar Committee. Issues and
problems related to e-Tanah faced by lawyers were discussed at the said
meeting. . Some key points highlighted by the Wilayah Land Office were:

transactions online (i.e. searches, submission and conversion)
