KLBC Activities Report for October and November 2016

Pupils Introduction Session
As a monthly tradition organised by the Pupils Committee, the Pupils Introduction Session for October was held on 5 October 2016. The session, attended by 72 pupils, was led by Shashi Devan and Dinesh Muthal. The purpose of the session is to introduce pupils to the structure of the Malaysian Bar and the Kuala Lumpur Bar, the election to both the Bar Council and the Kuala Lumpur Bar Committee (KLBC) and the highlights of the Malaysian Bar. It included a session for pupils to raise issues and problems faced by them during their pupillage period and other members of the KLBC were also present to provide input and possible solutions. Like previous sessions, the pupils were also shown a video montage of the History of the Malaysian Bar.

PDC Seminar on Family Mediation
Organised by the Professional Development Committee (PDC), this seminar was presented by Serene Ong Si Oui on 18 October 2016 at the KL Bar Auditorium from 3:00 pm to 5:00 pm. The seminar was attended by 16 participants. The seminar covered the following topics: "What is Mediation?"; "Why Mediate?"; "What can Mediation do that Litigation and Arbitration cannot?"; "The Mediation process"; "The lawyer's role in Mediation" and "Will Mediation replace Litigation".

Cheque Presentation to NASOM
On 22 October 2016, KLBC Chairman Ravin Singh and YLC Chairperson Alex Anton Netto presented the proceeds from the YLC Charity Gala held on 5 August 2016 amounting to RM37,000 to NASOM (National Autism Society of Malaysia). Representing NASOM in receiving the cheque were Razlin Murat (Chief Executive) and Anne Subashini Sivananthan (Assistant Honorary Secretary).

Meeting with the Wilayah Persekutuan Kuala Lumpur Land Office
The Corporate & Conveyancing Practice Committee was invited by the Bar Council Conveyancing Practice Committee to attend a meeting with the Wilayah Persekutuan Kuala Lumpur Land Office on 24 October 2016. The main issue discussed at the meeting was the amendments to the Garis Panduan Pendaftaran Urusniaga Dan Bukan Urusniaga PPTGWPKL.

YLC Seminar on The Fundamentals of Civil Procedure
Organised by the Young Lawyers Committee (YLC), this seminar was presented by Wan Zafran Pawancheek on 26 October 2016 at the KL Bar Auditorium from 2:30 pm to 5:00 pm. The seminar was attended by 55 participants. The seminar focused on basic civil procedure in the Malaysian Courts i.e: Court processes/sub-processes in practice and in relation to the Rules of Court 2012 and other aspects of civil procedure – case management, litigation/caseload management, document management (enclosures/cause lists/e-filing), conduct of proceedings (issues with applications, appeals, submissions, preparation of orders, service, practice direction compliance), exception handling (urgencies/delays, adjournments, witnesses, irregularities and non-compliances), interactions with courts/opponents/ clients, and other matters that may not be immediately obvious to unacquainted court practitioners.

YLC Visit to the Paediatric Ward at HKL
The members of the Young Lawyers Committee embarked on a visit to the paediatric unit of the Kuala Lumpur General Hospital (HKL) on 5 November 2016. The focus was on the little ones currently battling cancer. YLC was glad to have around 12 of its members present, equipped with Happy Meals from McDonalds, balloons and stuff toys to bring some much needed cheer to the children in the ward.

PDC Seminar on Acquisition and Disposal of Shares in Real Property Company of RM2 as the Paid up Capital
Organised by the Professional Development Committee (PDC), this seminar was presented by Lim Kien Chai on 8 November 2016 at the KL Bar Auditorium from 9:00 am to 5:00 pm. The seminar was attended by 85 participants. The seminar covered the following topics: "Revisit the business strategy of using RM2.00 paid-up company to buy and/or keep real property."; "What is Share sale in the context of a property investment company?"; "How does it differ from Asset sale by a property investment company?"; "How do you determine the price of the shares of Real Property Company?"; "How to differentiate chargeable gains accruing from the disposal of real property assets from the disposal of real property company shares?"; and "How to differentiate real property transactions resulting in capital or revenue gains?".

YLC Seminar on the Fundamentals of Admiralty Law in Malaysia
Organised by the Young Lawyers Committee (YLC), this seminar was presented by Trishelea Ann Sandosam on 9 November 2016 at the KL Bar Auditorium from 3:00 pm to 5:30 pm. The seminar was attended by 18 participants. The seminar covered the following topics: "Admiralty Jurisdiction"; "Ship Arrest as Security"; "Considerations before Arrest"; "Effect of Arrest"; "Security and Release"; "Maintenance of Ship during Arrest"; "Judicial sale of a Ship"; "Determination of Priorities"; and "Effect of Arbitration Clauses”.

Kuala Lumpur-Malacca Bar Series 2016
This Series was held at Forum 19, Seksyen 19, Petaling Jaya on 12 November 2016 with Kuala Lumpur Bar playing host. Kuala Lumpur Bar beat Malacca Bar in two games and drew one game, winning at Men’s Futsal 13-1, Ladies Futsal 7-2 and drawing at Badminton 2-2 to become the overall champion. The prize-giving lunch was held at B&W café in Forum 19 itself and was well attended by the participants from both Bars. Click here to view the photos.

CCPC Workshop on Anti-Money Laundering in Malaysia
Organised by the Corporate & Conveyancing Practice Committee (CCPC), this workshop was presented by Tee Suat Hong, Krishna Dhallumah and Donny Kwa on 15 November 2016 at the KL Bar Auditorium from 10:00 am to 5:30 pm. The seminar was attended by 38 participants. The seminar covered the following topics: “Introduction to AMLA”; “What are money laundering offences”; “Cases under AMLA”; “Do Legal Firms have obligations to report”; “Resources available”; “What are suspicious transactions”; “What is cash threshold for reporting”; and “Conflict of duty under s.126 Evidence Act on professional communication”.

Corporate Workshop for Pupils
The Pupils Committee organised a Corporate Workshop specifically for pupils on 17 November 2016 focusing primarily on the practical aspects of handling a brief covering the following areas, "Overview: Negotiation, Due Diligence and Drafting Process"; "Commercial Considerations"; "Practical Pointers including Common Mistakes when Drafting"; "Salient Clauses including Consideration, Conditions Precedent, Completion, Etc"; "Covenants and Warranties by both Vendors And Purchasers"; "Boiler Plate Clauses"; and "Remedies for Breach of Contract". 46 pupils attended the Workshop which was conducted by Addy Herg.

PDC Seminar for Lawyers on Profit from Disposal of Real Property: Capital Gains, Business Gains or Income?
Organised by the Professional Development Committee (PDC), this seminar was presented by Lim Kien Chai on 30 November 2016 at the KL Bar Auditorium from 3:00 pm to 6:00 pm. The seminar was attended by 63 participants. The primary objective of this seminar was to assist lawyers to guide their clients in determining whether a disposal of property is governed under RPGT Act 1976 or ITA 1967.
