PDC Seminar on An Introduction to
Arbitration
Choon Hon Leng from Messrs Raja,
Darryl and Loh presented the seminar which was held at the KL Bar Auditorium at
3.00pm on 1 August 2013. The seminar was attended by 26 participants. The
seminar covered the following areas: "How does arbitration work?",
"When and why do you go for arbitration?", "Drafting an
arbitration clause", "Commencing an arbitration",
"Conducting an arbitration" and "Enforcing and challenging an
arbitral award".

KL Bar Monthly Social Get-together
Close to 20 lawyers attended the
August Monthly Social Get-together on 2 August 2013 at D'Balcony @ Publika,
Solaris Dutamas. There was good interaction and camaraderie between the
lawyers.

Pupils Introduction Session
Organised by the KL Bar Pupils Welfare
Committee, the introduction session for August was held on 5 August 2013. The
session, attended by 43 pupils, was led by Vince Chong. Pupils were briefed on
the structure of the Malaysian Bar and the KL Bar, the election to both the Bar
Council and the KL Bar Committee and the highlights of the Malaysian Bar. It
included a session for pupils to raise issues and problems faced by them during
their pupillage period and members of the KLBC were on hand to provide input
and possible solutions. Amongst the issues raised by the pupils at this session
were late
payment of allowance resulting in pupils having to change firm of pupillage;
firms not subsidising filing fees for Admission papers and problems with the
RKKK Petition for Admission Registry.
PWC Corporate Workshop for Pupils
The
KL Bar Pupils Welfare Committee organised a corporate workshop specifically for
pupils on 19 August 2013 by Jeremiah R. Gurusamy focusing primarily on the
practical aspects of handling a criminal brief covering the following areas,
"Dealing with Compliance & Regulatory issues", "Scoping the
Transaction", "Drafting Techniques", "Understanding Key
Provisions", "Boiler Plate Clauses" and "Common Mistakes
& Pitfalls". 41 pupils attended the
workshop.

PDC Seminar on The U.S. Foreign
Corrupt Practices Act
Gustavo Llerena, the Chief Compliance
& Ethics Officer for Darden, U.S. presented the seminar which was held at
the KL Bar Auditorium at 3.00pm on 21 August 2013. The seminar was attended by
26 participants. The objective of the seminar was to highlight the key elements
of the U.S. Foreign Corrupt Practices Act, enforcement activity, and general
guidance provided by the U.S. Department of Justice and Securities and Exchange
Commission

PDC Seminar on Transfer Pricing:
Insight to Malaysia’s First Transfer Pricing Litigation
Siti Fatimah Mohd Shahrom from Messrs
Lee Hishammuddin, Allen & Gledhill presented the seminar which was held at
the KL Bar Auditorium at 3.00pm on 23 August 2013. The seminar was attended by
24 participants. The seminar covered the following areas: "OECD Transfer
Pricing Guidelines", "Income Tax (Transfer Pricing) Rules 2012",
"IRB’s Transfer Pricing Guidelines" and "MM Sdn Bhd v Ketua
Pengarah Hasil Dalam Negeri: A brief analysis on Malaysia’s first transfer
pricing litigation, involving the applicability of Section 140(1) of the Income
Tax Act 1967 in the adjustment of commission rates by the IRB and whether
business process improvement services & regional services were
rendered".

Interstate Bar Games
The KL Bar hosted the Malaysian
Interstate Bar Games on 24 August 2013 at the Kompleks Sukan Negara Shah Alam
(Panasonic). The sports played were badminton, soccer, netball and volleyball.
The following State Bars participated in the Games; KL Bar, Selangor Bar,
Malacca Bar, Kedah Bar, Johor Bar, Penang Bar, Kelantan Bar and Terengganu Bar.
The overall Champions were the KL Bar who won 3 of the 4 games played namely
Netball, Volleyball and Badminton. Football was won by the Selangor Bar. Click here to view the photos.

CPC Briefing on “Perintah Kahadiran
Wajib”
The Criminal Practice Committee
together with the Jabatan Penjara Malaysia had successfully organised a FREE
briefing on the PKW. The Briefing was given by Tuan Abdul Aziz Bin Mohamad,
Director of the Department of Parole and attended by 48 participants. The
parole officers from the 3 districts of Kuala Lumpur (Wangsa Maju, Cheras and
Ampang) came for the briefing as well.

& Partners presented the seminar which was held at the KL Bar Auditorium at
3.00pm on 28 August 2013. The seminar was attended by 44 participants. The

Years", "Consequence of Bad Pleading", "More Usage of the
“Reportage Defence", "The Reynold’s 10 Point Question",
"Types of Damages" and "General Mitigating Factors".

presented the seminar which was held at the KL Bar Auditorium at 2.00pm on 29
August 2013. The seminar was attended by 83 participants. The seminar covered
the following areas: “Interactive – ‘Where do you stand?’ Discussion",
"International Human Rights Law (Treaties and Instruments)",
"Limitations of Human Rights", "Human Rights and Law",
"State of Human Rights in Malaysia", "What Can A Lawyer Do"
