SACC Movie Night
The KL Bar Social, Arts and Culture Committee ("SACC") organised a private movie screening of Marvel’s The Avengers on 03 May 2012 at the Golden Screen Cinemas, Pavilion KL. The event drew a large crowd of lawyers who came with family and friends to enjoy a night of action and entertainment. The SACC is pleased to have sold all tickets to this movie screening and would like to thank everyone for their support.

Pupils Introduction Session
Organised by the KL Bar Pupils Welfare Committee (PWC), the introduction session for May was held on 07 May 2012. The session, attended by 90 pupils, was led by Jason Kong. Pupils were briefed on the structure of the Malaysian Bar and the KL Bar, the election to both the Bar Council and the KL Bar Committee and highlights of the Malaysian Bar. The introduction session included a session for pupils to raise issues and problems faced by them during their period of pupillage and the Chairman and members of the KLBC were on hand to provide input and possible solutions. The issues raised by the pupils at this session were divided into the areas of Court, Office and Miscellaneous matters, with the following brief details:

Court
  • Rude Court Staff – Petitions for Admission Registry and the Payment Counters
  • E-Filing - Payment counters and filing counters at different areas. Time wastage to queue up for both counters
  • People jumping queue at the payment counters
  • Late arrival of officers at the e-filing counters. Counters open at 8.30am but the officers only arrive at 9.00am.
  • Shah Alam Court - No QMS system in the old building
  • Extraction of documents - delayed reply ie 2 weeks or no reply at all
  • Case management: ~  Shah Alam Court - the wait is too long as the cases are not registered. ~  KL Court - after keying in the QMS, one still has to fill up the form
  • Parking at the Shah Alam Court, KL Court and KL Bar Secretariat is a problem
  • Java Script is an issue - unable to extract or view the file
  • Car stickers - Security guards at the KL Court Complex not allowing pupils to park inside the Cour compound as they do not have the Bar Council car stickers
Office
  • Hierarchy - Some senior partners treat the pupils in their firm badly
  • Given administrative and despatch work instead of training
  • No access to proper resources for research
  • No training schedule
  • Delay in the reimbursement of claims
  • Not paid for overtime
  • Little or no interaction with the Master - Master not knowing his/her pupil as the pupil ended up working for the Legal Assistant only
  • Firms not willing to use Transcribing Services and pupils were made to handle the transcription instead
  • Gender equality issues - female pupils are not taken to Court as the Master prefers to take male pupils
  • Poor allowances
  • Lack of IT System in the firm
Miscellaneous
  • KL Land Office -  Unfriendly staff
  • Admission to the Bar date - the wait is too long

PDC Seminar on Islamic Wills I (Basic)
Amir Bahari from Messrs Bahari & Bahari presented the seminar which was held at the KL Bar Auditorium at 10.00am. The seminar was attended by 43 participants. The seminar covered the following areas, “Key Objectives in Estate Planning”, “Legal Framework of Estate Administration”, “Faraid - Islamic Laws of Inheritance”, “Sources of Islamic Will”, “6 Steps in Estate Planning”, “Issues in Islamic Estate Planning” and “Sample of Islamic Basic Will”.

KL Bar Blood Donation Campaign
With the assistance of the National Blood Bank, a Blood Donation Drive was held on 14 May 2012 at Level 2 of the Kuala Lumpur Court Complex at Jalan Duta. Members of the Bar, Court staff and members of the public nobly came forward to participate in this Blood Donation Drive. A total of 54 donors registered. Unfortunately, only 43 were eligible to donate. The 11 were rejected because they were either underweight, having high blood pressure or low blood pressure or had lived in the United Kingdom from 1980 till 1996 or in Europe between 1980 until the present.  A total of 43 units of blood were collected from the caring donors. PDC Seminar on Family Law Practice in the Mediation System
Lim Siew Symn from Messrs Thomas Philip and Tong Soo Tim from Messrs Tong S-Tim and Associates presented the seminar which was held at the KL Bar Auditorium at 2.30pm. The seminar was attended by 41 participants. The seminar covered the following areas, "Arguing for Family Law Practice as a Specialised Area of Practice", "How to handle Family Law matters", "Various options available for resolving Family Breakups", "Mediation vs. Litigated Divorce", "The Mediator's Role" and "Mediation Costs".

PDC Seminar on Professional Misconduct
Datuk Jerald Gomez from Messrs Jerald Gomez and Associates presented the seminar which was held at the KL Bar Auditorium at 3.00pm. The seminar was attended by 23 participants. The seminar covered the following areas,  "What constitutes Professional Misconduct", "The rationale and ambit of why lawyers are held to a higher standard", "How to avoid being the subject matter of a complaint and investigation" and "When faced with a complaint, the best manner to respond".

PDC Seminar on An Introduction to The Industrial Relations Act
Wong Keat Ching from Messrs Zul Rafique and Partners presented the seminar which was held at the KL Bar Auditorium at 3.00pm. The seminar was attended by 23 participants. The seminar covered the following areas, “A Preamble of the Industrial Relations Act 1967 (“IRA”)”, “Section 26 of the IRA”, “Section 33 of the IRA”, “Section 56 of the IRA”, “Section 20 of the IRA”, “The Remedies available”, “Grounds for Dismissal/Termination” and “The Power of the Industrial Court under the IRA”.

Pupils Workshop on Conveyancing
The workshop, organised by the KL Bar Pupils Welfare Committee specifically for pupils, was presented by Michael Leow Yon Meng on 24 May 2012 at 3.00pm. The workshop focused primarily on the practical aspects of handling a conveyancing brief, overview of the conveyancing process, essential clauses found in a Sale & Purchase Agreement, how to fill up the relevant NLC Forms and practical pointers for a conveyancing case. The workshop was attended by 29 pupils.

PDC Seminar on Tax Issues in Financial Transactions
S. Saravana Kumar from Messrs Lee Hishammudin Allen and Gledhill presented the seminar which was held at the KL Bar Auditorium at 3.00pm. The seminar was attended by 27 participants. The seminar covered the following areas,  "Section 29: Interest obtainable on demand - what is the meaning of obtainable?", "Section 22(2): Does receivable include release of debt?", "Section 30(4): Does it include the release of debt from non-business income source?", "Section 140(1): can Section 140(1) be used for thin capitalisation?", "Section 140(1): can Section 140(1) be used for transfer pricing?", "Section 33(1): are bank guarantee fees, pre-payment penalty and rating fees deductible?" and "Section 33(1)(a): must interest be disbursed to be eligible for deduction?"

KBSM Watersports Carnival
The KL Bar’s Dragon Boat Team, KLBAR-Barbarians combined with the Skrine Dragons to compete at the Kementerian Belia dan Sukan Malaysia’s Watersports Carnival at Putrajaya. A full report will follow soon.

PDC Seminar on Service Level Agreements
Jeremiah R. Gurusamy from Messrs Arianti Dipendra Jeremiah presented the seminar which was held at the KL Bar Auditorium at 2.30pm. The seminar was attended by 71 participants. The seminar covered the following areas, "Characteristics of an SLA", "Drafting a SLA", "Typical Clauses for a SLA", "Outsourcing of Human Resources", "Specifying Quality of Service", "Measuring Performance" and "Risk Management/Mitigation Policies".
